Chap. 66.—An ACT to amend and re-enact sections 2, 7, 8 and 10 of chapter
450 of the acts of 1920, entitled “An act to provide a new charter for the
town of Narrows, and to repeal all other acts and parts of acts in conflict
with the provisions of this act,’ approved March 24, 1920. [S B 159]

I. Be it enacted by the general assembly of Virginia, That sec-
tions two, seven, eight and ten of chapter four hundred and fifty of the
acts of nineteen hundred and twenty, entitled “An act to provide a
new charter for the town of Narrows, and to repeal all other acts and
parts of acts in conflict with the provisions of this act, approved March
twenty-fourth, nineteen hundred and twenty, be amended and re-enacted
so as to read as follows:
Section 2, The council of said town shall be composed of a mayor
whose term of office shall be two years and five councilmen, whose
term of office shall be four years; provided, however, that of the five
persons elected as councilmen at the election to be held in said town on
the second Tuesday in June, nineteen hundred and thirty, the term of
office of the two who shall receive the lowest and next lowest number
of votes, respectively, shall be two years, and their successors shall be
chosen at an election to be held in said town for the purpose, on the
second Tuesday in June, nineteen hundred and thirty-two, for a term
of four years; and thereafter, as the respective terms of office of all of
said councilmen shall expire, their successors shall be elected for terms
of four years.
The said council shall be a continuing body and no measure pend-
ing before such body shall abate or be discontinued by reason of the
expiration of the term of office, or the removal of the members of
said body, or any of them. Vacancies in the council shall be filled for
the unexpired term, within thirty days, by a majority vote of the re-
maining members, except as otherwise provided by general law. The
mayor and three councilmen shall constitute a quorum.
Section 7. The sergeant, in addition to the powers and duties con-
ferred and imposed on him by law, shall be chief of the police force
of the town, and shall report to the council, any misconduct or non-
performance of duty on the part of any policeman. The sergeant
and policemen shall be under the control of the mayor for the purpose
of enforcing peace and order and for the execution of the laws and
ordinances of the town and the performance of such other duties as
may be prescribed by the council.
The sergeant shall, before entering upon the discharge of his duties,
enter into bond with such penalty as the council may prescribe, not less,
however, than five thousand dollars, which bond may be given in a
bonding company approved by the council, the cost thereof to be paid
out of the general funds of the town. The sergeant shall not hold any
other office, or engage in any other employment, at any time during
his incumbency in office as such sergeant.
Section 8. The treasurer, who may be a member of the council,
or some other freeholder residing in the town shall make out all tax
tickets when due, and mail statements thereof to the tax payers; receive
and collect all funds due and belonging to the town, and have executed
all liens and levies for unpaid and past due taxes; shall keep a record
of all funds and pay accounts only on warrants drawn by the clerk
and countersigned by the mayor, and shall make such reports to the
council as it may from time to time require of him. The records of
the treasurer shall be kept in a fireproof safe at the municipal build-
ing at all times; and the said records shall be audited once each twelve
months, and at the end of the treasurer’s term of office, by a competent
auditor approved by the council; provided, however, that the council
may in its discretion, have the sergeant, instead of the treasurer, col-
lect the town taxes, licenses, etc., and pay the same over to the treasurer,
and make such reports as they may require.
Section 10. In order to raise the necessary funds for the general
purposes of the town, including general expenses of the town govern-
ment, pay of officers, the general improvement and upkeep of the town,
and the roads and streets therein, and to provide for the payment of
the interest, and a sinking fund for the redemption of the principal
of bonds and other indebtedness of the town, the council shall have
the power to levy, annually, a capitation tax not to exceed one dollar
on every male person in the town, not exempt by law from the pay-
ment of the State capitation tax; and also to levy a property tax not
to exceed two dollars on the one hundred dollars of the assessed value
thereof, on all the property, both real and personal, within the cor-
porate limits of the town, subject to local taxation under the general
laws of Virginia, and shall also be entitled to receive from the county
treasurer of Giles county, the net amount of district road tax levied
on the property in said town, subject to local taxation, and collected
by said treasurer.
