Chap. 64.—An ACT to authorize the State highway commission to include in
the State highway system certain streets and roads in incorporated towns
and cities of thirty-five hundred (3,500) inhabitants or less. [S B 152]

1. Be it enacted by the general assembly of Virginia, That the
State highway commission be and is authorized, by and with the con-
sent of the chief executive and the governing body of such town or
city, to incorporate in the State highway system such streets and roads
or portions thereof in incorporated towns or cities of thirty-five hun-
dred inhabitants or less according to the United States census of nine-
teen hundred and twenty, as may in its judgment be best for the hand-
ling of traffic through such town or city from or to any road in the
State highway system, and may, in its discretion, eliminate any of
such roads or streets or portions thereof from the State highway sys-
tem. Every such action of the State highway commission incorpora-
ting any such road or street or portion thereof in the State highway
system, or eliminating it therefrom, shall be recorded in its minutes.
2. Any such road or street or portion thereof in any such city
or town so incorporated in the State highway system, shall be subject
to the rules, regulations and control of the State road authorities as
are other roads in the State highway system, provided such town or
city shall be obligated to pay the maintenance and construction and
re-construction costs of such roads or streets or portions thereof so
incorporated in the State highway system in excess of the amounts
authorized to be spent by the State highway commissioner on such
roads or streets under the provisions of section twenty-one hundred
and fifty-four of the Code of Virginia as amended.
3. Every provision in the charter of any such town or city, or in
any other act, insofar as it is in conflict with this act, is hereby repealed.
4. The State highway commissioner may in his discretion permit
such town or city to maintain any such road or street, or portion
thereof, incorporated in the State highway system, and reimburse such
city or town up to such amount as he is authorized to expend on the
maintenance of such road or street, or portion thereof.

sioner in the several classes now on the pension roster, or
hereafter placed on the pension roster, who is entitled un-
der the act to appropriate public revenue, approved March
9, 1928 (acts of general assembly, 1928, chapter 110), to
$320.00 a year, for total blindness, $540.00 a year; to $200.-
00 a year for total disability, $360.00 a year; and to each
widow of a soldier, sailor or marine, who was married prior
to January 1, 1890, and who is otherwise entitled under
this act to a pension, $120.00 a year, and to such widow
who is blind, $240.00 a year and to each widow of a Con-
federate soldier married on or after January 1, 1890, who is
over 75 years of age, $120.00; and to soldiers proven to be
totally deaf by certificate of a reputable practicing physi-
cian and affidavits by two reputable unrelated disinterested
citizens, who are fully acquainted with the applicant, $540.-
00 a year; and to the personal representative of each de-
ceased pensioner $50.00 for the funeral expenses of such
deceased pensioner, provided however that the said sum
of $50.00 may be paid without the qualification of a per-
sonal representative to the undertaker, when such under-
taker shall file his bill, verified by proper affidavit with
the Comptroller together with copy of death certificate of
such pensioner, and the allowances as authorized by the act
aforesaid; provided, further, that under the provisions of
this act any person who actually accompanied a soldier in
the service and remained faithful and loyal as the body
servant of such soldier, or who served as cook, hostler or
teamster, or who worked on breastworks under any com-
mand of the army and thereby rendered service to the Con-
federacy shall be entitled to receive an annual pension of
$96.00, proof of service to be prescribed by the Comptrol-
ler.
Any wunexpended portion of this appropriation shall
revert to the general fund of the State treasury and na
part thereof shall be prorated among pensioners.
And it is further provided that out of the appropria-
tion for public printing, the director of the division of pur-
chase and printing shall supply all forms and have done and
pay for all printing, binding, ruling, etc., required by the
comptroller in pension matters, and in connection with
the payment of pensions. The comptroller shall pay
monthly, at such dates as he may prescribe, the pensions
authorized by this act.
It is further provided that out of this appropriation of
one million dollars, there shall be expended for relief of
needy Confederate women of Virginia, who are not upon
the State pension roster, and who are not inmates of any
Confederate, independent or church home or charitable
institution, in accordance with the provisions of the act
approved March 10, 1914 (acts of assembly, 1914, chapter

It is hereby provided that all fees and licenses col-
lected by the division of motor vehicles for licensing
motor vehicles and for issuing and registering certificates
of title thereto and all taxes collected by the division of
motor vehicles on motor vehicle fuels, including, in addi-
tion to all other fees, licenses, and taxes, all monies re-
ceived by the division of motor vehicles under the pro-
visions of the act which became a law July 1, 1924 (acts
of assembly, 1924, chapter 368, pages 523-532), relating
to the protection of titles to motor vehicles and to the
purchase, sale and storage thereof, after the close of busi-
ness, February 29, 1930, together with any funds previ-
ously collected for these purposes and still unexpended in
the hands of the division of motor vehicles as of said date,
shall be paid directly and promptly into the State treas-
ury, to the credit of the State highway maintenance and
construction fund, without deductions of any kind being
made therefrom; and it is provided, further, that all funds
held within the State treasury to the credit of the automo-
bile theft fund at the close of business on February 28,
1930, shall be promptly transferred to the credit of the said
State highway maintenance and construction fund, and
the said automobile theft fund is hereby abolished; and it
is further provided that the funds herein appropriated for
licensing and registering motor vehicles and recording
titles thereto, and for collecting the taxes on motor vehi-
cle fuels and for carrying out the other duties imposed by
law upon the division of motor vehicles, shall be paid out
of the State highway maintenance and construction fund
by warrants drawn on the comptroller by the division of
motor vehicles.
Provided, however, that nothing in this act shall in-
terfere with the distribution of the revenue from the one
and one-half cent tax per gallon on motor vehicle fuels to
the several counties of the State, in accordance with the
provisions of the act approved March 26, 1923 (acts of as-
sembly, 1923, extra session, chapter 107, pages 125-129, as
amended).

of this sum of $780,000 segregated for vacation schools may
be used in cities as well as in counties.
Out of this sum of $780,000 segregated to the establish-
ment and maintenance of rural elementary schools, the
State board of education may use not exceeding $20,000
for the establishment and maintenance of vacation schools
in such sections of the State as the State board of educa-
tion may deem wise and proper. Any unused balance of
this sum shall revert to and become a part of the elemen-
tary fund.
It is provided that the entire monies in this whole
appropriation of $5,344,185, except as otherwise provided,
shall be apportioned by the State board of education, as
prescribed by section 135 of the Constitution of Virginia,
on a basis of school population, to the public free schools
of the several counties and cities of the Commonwealth;
provided, further, however, that the said State board
of education shall not apportion any of the said fund
to any county or city unless said county or city pay out
of local funds at least twenty per centum of the teachers’
salaries in the said county or city; and provided, further,
however, that in exceptional cases the State board of edu-

There is hereby appropriated to the State Commission on
Conservation and Development “for acquisition of area for the
Shenandoah National Park” any balance remaining unexpended
at the close of business on February 28, 1930, in the appropria-
tion of $1,000,000 made to the State Commission on Conserva-
tion and Development for acquisition of area for the aforesaid
park, by chapter 110 of the Acts of Assembly of 1928, provided
further that such unexpended balance in the aforesaid appro-
priation of $1,000,000 shall be used only for the proceedings for
the acquisition and the acquisition, by the State Commission
on Conservation and Development, at a reasonable price, of
land lying within the area recommended by the secretary of the
interior for inclusion in the proposed Shenandoah National
Park. It is further provided, that no part of this appropriation
shall be paid out of the State treasury for the purchase of land
within the area until and unless the governor shall have trans-
mitted to the comptroller, with his approval, a report submitted
by the State Commission on Conservation and Development,
showing that the pledges to the fund for the acquisition of area
for the proposed Shenandoah National Park have been collected
to the fullest possible extent, and showing further, that there
are sufficient funds available, as accurately as can be estimated,
with the addition of such funds as may have been pledged from
sources outside the State, to enable the said Commission on
Conservation and Development to acquire title to at least sufh-

cient land within the proposed park area to meet the minimum
requirements for acceptance as a national park, by the secretary
of the interior, on behalf of the United States, in accordance
with the provisions of the act of Congress approved May 22,
1926, or any amendment thereto.
It is provided further, however, that by resolution of the
State Commission on Conservation and Development, approved
by the governor, not to exceed one hundred thousand dollars of
this appropriation may be used for the development of the pro-
posed park area and the promotion of the Shenandoah National
Park project.

It is provided that this appropriation of $100,000.00
may be expended by the State Commission on Conserva-
tion and Development with the approval of the Governor,
for the acquisition by purchase, gift or condemnation,
of lands lying within the State of Virginia and on James-
town Island for a public park or a public monument, or
for public park or public monument purposes. Said ac-
quisition may be in whole or in part by any one of the
three enumerated methods, provided, however, that that
part of the Island now held by the Association for the
Preservation of Virginia Antiquities shall not be acquired
by condemnation.
It is provided further that the State Commission on
Conservation and Development, with the approval of the
Governor, may either expend this appropriation of $100,-
000.00 directly for the acquisition of said lands, or place
the entire appropriation or any part thereof, at the disposal
of the United States of America, or the officers or agents

It is provided that no part of this appropriation of $200,-
000 shall be available until plans have been submitted to, and
approved by the Governor, for the construction of a complete
plant, to care for not less than one hundred blind children, at
a total cost of not exceeding two hundred thousand dollars, and
the Governor is satisfied that the complete plant can be con-
structed for not more than two hundred thousand dollars.
2. The appropriations provided for in this act for making loans
o students at the several State institutions shall be expended, upon
such terms and according to such rules as may be prescribed by the
‘espective governing boards of the institutions for which the appro-
yriations are made, in making loans to needy and deserving students
of talent and character from Virginia in said institutions for the pur-
pose of aiding these to obtain an education at such institutions, who
might not be able otherwise to do so. Such loans shall not exceed
$200.00 in any one session to the same student; and they shall be made
to said students upon such terms, as to time and security, as the comp-
troller shall prescribe; provided, however, that the rate of interest
charged said students on such loans shall not be less than four per
centum per annum.
The said State students’ loan funds shall be preserved from de-
pletion by the said institutions; and, together with the repayments and
accretions thereto, shall be held and used for the purpose specified in
this act and no other; and each of the said institutions shall annually,
not later than July in each year thereafter, file, in the office of the
superintendent of public instruction, a statement, in detail, showing for
the year past the amounts received by said funds, or the loans made,
to whom made, and upon what terms, the amount of the corpus of said
fund, the amounts repaid to said funds, and from whom, and any other
information deemed pertinent by the institution so reporting, or which
may have been requested by the superintendent of public instruction.
The comptroller shall make no payment to any of the said institu-
tions on account of the said students’ loan funds unless and until the
institution applying for such payment shall have furnished the said
comptroller a certificate from the superintendent of public instruction
that such institution has complied, in all respects, with the foregoing
requirements of this act in relation thereto.
The auditor of public accounts shall annually audit and exhibit in
his annual report the account of the said funds at each of the said
institutions.
Where the student loan fund created by State appropriation 1:
inadequate in amount at any institution to carry out fully the purpose
for which this fund was established, the governing board and presi-
dent of such institution, with the written consent and approval of suct
institution, with the written consent and approval of the governor first
obtained, is authorized, for the purpose of providing an additiona
student loan fund, to borrow from such sources and on such terms as
may be approved by the governor an amount not to exceed $10,000.
Such fund shall be used only in making loans to students in the same
circumstances and under the same terms and regulations, as are herein
prescribed for loans from the fund created by the State appropriation,
and for no other purpose whatever. The repayments and interest ac-
cretions to said fund shall be used so far as may be necessary to repay
the indebtedness of the institution created by the governing board and
presiding officer thereof, in establishing said additional student loan
fund. Such additional amounts may be borrowed by the governing
board and president of the institution, with the governor’s approval,
from time to time, as may be necessary to maintain the amount of said
additional loan fund, including cash and notes receivable, at $10,000.
Accounts shall be kept and reports rendered for all such additional
loan funds in all respects as herein required for loan funds created by
State appropriation, and the auditor of public accounts shall annually
exhibit in his report the accounts of the said additional loan funds at
each institution.
3. All of the taxes upon inheritances collected on and after March
1, 1928, regardless of the date of the death of the decedent, shall, when
collected, be paid promptly and directly into the general fund of the
State treasury.
4. All revenues collected by the commission of fisheries, all other
laws or parts of laws to the contrary notwithstanding, shall be paid
promptly and directly into the general fund of the State treasury.
5. All monies hereafter paid into the State treasury by or on
behalf of any county, city or other political subdivision of this State,
hy way of reimbursement, or partial reimbursement, to the State, as
required by law, for the cost of any audit or examination of the books
and records of any such political subdivision, or of any officer or
agency of any such political subdivision, made by the State accountant
(or on and after the first day of March, nineteen hundred and twenty-
eight. by the auditor of public accounts), in pursuance of law, shall be
paid into the general fund of the State treasury; and any unexpended
balance existing on the date this act takes effect in any special fund
or special funds, heretofore derived in the manner as aforesaid, shall
on such date be converted into the general fund of the State treasury.
6. All monies, fees, taxes and other charges hereafter collected by
or on behalf or on account of the dairy and food division of the de-
partment of agriculture and immigration in pursuance of law, from
whatever source, or on account of the laws administered by the said
division or the said department, shall be paid promptly and directly
into the general fund of the State treasury; and any unexpended bal-
ance existing on the date this act takes effect in any special fund or
special funds, heretofore derived in the manner as aforesaid, shall on
such date be converted into the general fund of the State treasury.
This paragraph includes the fund known as the dairy and food inspec-
tion fund and the fund known as the sale of reacting animals fund.
7. All monies, fees, taxes and other charges hereafter collected
by or on behalf or on account of the division of markets of the de-
partment of agriculture and immigration, in pursuance of law, from
whatever source, or on account of the laws administered by the said
division or the said department, shall be paid promptly and directly
into the general fund of the State treasury; and any unexpended balance
existing on the date this act takes effect in any special fund or special
funds, heretofore derived in the manner as aforesaid, shall on such
date be converted into the general fund of the State treasury. This
paragraph includes the fund known as the voluntary inspection fund.
8. All fees and other charges hereafter collected by or on behalf
or on account of the State corporation commission, or any division or
bureau thereof, in pursuance of law, for the examination and super-
vision of banks, small loan companies, credit unions and building and
loan associations, and for regulating the sale of securities, and all taxes
levied and collected under the provisions of the act approved March
20, 1924 (acts of assembly, 1924, chapter 374, pages 536 to 538, in-
clusive), upon the annual gross receipts of certain classes of public
service companies doing business in Virginia and upon the gross re-
ceipts of the Virginia pilots’ association, shall be paid promptly and
directly into the general fund of the State treasury; and any unex-
pended balance existing on the date this act takes effect in any special
fund or special funds, heretofore derived in the manner as aforesaid,
shall on such date be converted into the general fund of the State
treasury.
But with the written consent and approval of the governor first
obtained, the State corporation commission may spend, in addition to
the appropriations herein made, in and about the examination of banks
and other such companies, and the supervision, inspection and regula-
tion of concerns conducting an insurance business, any additional reve-
nues paid into the State treasury from fees or other charges for the
examination of banks and other such companies and the supervision,
inspection and regulation of concerns doing an insurance business.
9. All penalties imposed by sections 8, 9, 10 and 11 of the tax
bill, as amended, for failure to comply with the provisions thereof,
and all sums received in pursuance of offers in compromise of prosecu-
tion for violation of the tax laws, shall be hereafter paid into the gen-
eral fund of the State treasurv, and the special or separate fund created
by subsection 4 of section 11 of the tax bill, as amended by an act
approved March 31, 1926, for expenditure by the State tax commis-
sion and its successor, is hereby abolished ; and any unexpended balance
existing on the date this act takes effect in the special or separate fund
created by the said subsection of the said act shall on such date be
converted into the general fund of the State treasurv.
10. All monies, fees, taxes and other charges hereafter collected
by or on behalf or on account of the department of agriculture and
immigration, in pursuance of law, from whatever source, or on account
of the laws administered by the said department, or any division or
section thereof, shall be paid promptly and directly into the general
fund of the State treasury; and any balance existing on the date this
act takes effect in any and all special funds, heretofore derived in the
manner as aforesaid, shall on such date be converted into the general
fund of the State treasury. This paragraph includes the fund known
as the hog cholera serum fund, the fund known as the fertilizer fund,
the fund derived from the registration and certification of nurseries,
and such other special funds as are hereinbefore described.
11. All fees hereafter collected for the examination and licensing
of motion picture films publicly exhibited in Virginia, together with
all other receipts from all sources collected for the support of the
division of motion picture censorship, shall be paid direct and promptly
into the general fund of the State treasury.
12. All fees and charges collected by or on behalf of the Virginia
real estate commission for licensing and regulating real estate brokers
and real estate salesmen, in accordance with the provisions of chapter
461 of the acts of assembly of 1924, or any amendment thereto, shall
be paid promptly and directly into the general fund of the State
treasury.
13. All fees hereafter received or collected by or on behalf of the
State registrar of vital statistics under the provisions of chapter 371
of the acts of assembly of 1924, or any amendment thereto, shall be
paid directly and promptly into the general fund of the State treasury.
14. All revenues hereafter collected from the license tax imposed
on pistols and revolvers under the provisions of chapter 158 of the
acts of assembly of 1926, after the payment therefrom of fees allowed
commissioners of the revenue, by law, if any, for the collection of such
revenue shall be paid direct and promptly into the general fund of
the State treasury and shall be subject to appropriation to the same
extent and for the same purposes as other general fund revenues.
The department of taxation is hereby authorized to require com-
missioners of the revenue to aid in the administration of the revenue-
raising provisions of the said chapter 158 of the acts of 1926 and may
allow a fee of ten cents to each commissioner of the revenue for each
pistol or revolver license issued as the result of work done by such
commissioner of the revenue. Such fees so allowed shall be paid to
the commissioners of the revenue entitled thereto upon warrants of
the comptroller issued on certificates signed by the State tax com-
missioner.
15. The appropriation in this act of a specific amount for the
examination of the accounts of local governmental units shall not be
construed as prohibiting the examination or audit, by the auditor of
public accounts, of the books or records of any county, city or other
political subdivision, or any officer or agency thereof, of this State, the
cost of which audit or examinations, is required by existing laws to
be borne by the said county, city or other political subdivision, and the
auditor of public accounts is hereby authorized, with the written con-
sent and approval of the governor first obtained, to make such expendi-
tures, in addition to the specific appropriation made in this act for the
examination of the accounts of local governmental units, as may be
necessary to give effect to this provision.
16. It is hereby provided that no public funds or money shall be
expended by any State institution of higher learning to which an ap-
propriation is made by this act, for the purpose of paying for advertise-
ments or advertising intended or designed to promote student attend-
ance at any such institution.
17. The governor is hereby authorized to fix and prescribe a uni-
form rate of compensation to be paid by the Commonwealth or.any
agency or officer thereof for the use of motor vehicles, not owned by
the Commonwealth or its agencies, in its business or about its affairs.
Such authorization shall extend to the prescribing of different rates
for different classes of motor vehicles as the governor may deem ad-
visable. All payments hereafter made for the use of such motor ve-
hicles shall be in accordance with the rate or rates fixed by the governor.
18. Subject to the approval of the State board of education first
obtained, the governing boards of the University of Virginia, the Vir-
ginia Polytechnic Institute, and William and Mary College are hereby
severally authorized, through the commissioners of the sinking fund,
to issue and sell certificates of indebtedness in the names and on behalf
of the institutions respectively to raise funds for the construction
and/or completion of dormitories and equipment thereof, subject to
the conditions or limitations hereinafter set out. All buildings con-
structed with funds derived from such certificates of indebtedness shall
be as nearly fireproof as is possible and all the money made available
by this act to the institutions named therein shall be used only for the
construction and/or completion of dormitories and the equipment
thereof. ,
The amount of certificates of indebtedness which may be issued on
behalf of each of the institutions herein named shall be as follows:
For the construction and/or completion of dormitories and equip-
ment thereof :
The University of Virginia an amount not exceeding two hundred
thousand ($200,000.00) dollars.
William and Mary College an amount not exceeding two hundred
thousand ($200,000.00) dollars.
The Virginia Polytechnic Institute an amount not exceeding thirty-
seven thousand, five hundred ($37,500.00) dollars.
The certificates of indebtedness issued under the provisions of this
act shall be signed on behalf of the institutions in the names of which
they are issued by the presiding officers of their governing boards, re-
spectively, and shall be countersigned by the State treasurer, who will
keep an account thereof in his office. The certificates of indebtedness
issued under this act are the certificates of institutions issuing them,
respectively, and not the certificates of the State.
The said certificates of indebtedness shall bear interest payable
semi-annually January first and July first, of each year, the rate not
to exceed five per centum per annum. The said certificates shall be
issued in such denominations as may be prescribed by the State board
of education after consultation with the sinking fund commissoners,
and shall mature serially during a period of fifteen years, the first
certificate to be due and payable January first, nineteen hundred and
thirty-two and annually thereafter until the total amount has been paid.
The loans made under this act, including interest thereon, shall
constitute a specific lien on all the grounds, buildings and additions
thereto of the several institutions obtaining said loans, and all such
buildings shall be kept fully and adequately insured for the benefit of
the literary fund, or the other owner or owners of such certificates,
and the policy or policies of insurance shall be kept on file in the office
of the State treasurer.
The State board of education is hereby authorized, in its discretion,
to sell any bonds of the State held as a part of the literary fund, and
to invest the proceeds derived from the sale of such bonds in the certifi-
cates of indebtedness issued under the provisions of this act. The
State board of education is further authorized, in its discretion, to
invest any uninvested portion of the literary fund in the certificates of
indebtedness issued under the provisions of this act, and all such cer-
tificates purchased with funds belonging to the literary fund shall be-
come the property of and a part of that fund. In the event that suffi-
cient funds are not available for the purchase of all such certificates
with money belonging to the literary fund, or the proceeds arising from
the sale of the bonds hereinabove referred to, the commissioners of the
sinking fund are authorized and directed, when and as required by the
State board of education to do so, to invest any uninvested portion of
the sinking funds created for the payment of the certificates of indebt-
edness issued under authority of chapter four hundred and eighty-nine
of the acts of nineteen hundred and twenty-six and any uninvested
portion of the sinking funds created for the payment of the certificates
issued under authority of chapter sixty-one of the acts of nineteen
hundred and twenty-eight, or to sell any or all of the securities now
held in the said sinking funds, and to sell the securities now held by the
sinking fund under the provisions of chapter ninety-three of the acts
of assembly of nineteen hundred and twenty-seven, to retire school
and college certificates, and to invest the proceeds of the sale of such
securities in certificates of indebtedness hereinbefore described, or ta
sell the said certificates of indebtedness for cash at such prices, not
less than par, as may be approved by the governor and said commis-
sioners. But in the event that any part of the sinking funds created
by chapter four hundred and eighty-nine of the acts of nineteen hun-
dred and twenty-six and chapter sixty-one of the acts of nineteer
hundred and twenty-eight is invested in said certificates, the certifi-
cates purchased therewith shall be made payable not later than the day
before the day on which the certificates issued under said chapter fout
hundred and eighty-nine of the acts of nineteen hundred and twenty-
six and chapter sixty-one of the acts of nineteen hundred and twenty-
eight will mature and be entitled to payment out of said sinking funds
The sums of money loaned from the literary fund, as above pro-
vided or received from the sale of certificates of indebtedness issued
and sold under the provisions of this act, shall be paid into the State
treasury to the credit of the institutions on behalf of which such cer-
tificates are issued, and such amounts so paid into the treasury to the
credit of such institutions, respectively, are hereby appropriated to and
may be expended by the governing boards, respectively, for the con-
struction and completion of dormitories for the use of students of the
respective institutions and for no other purpose whatsoever. All pay-
ments out of the treasury shall be made upon order of the comptroller.
The plans, bids, and costs of the buildings shall be acted upon and
approved by the governing boards of the respective institutions and the
State board of education. All rents and fees received from students
or other persons for use of the dormitories constructed under the pro-
visions of this act, shall be promptly paid by the several institutions,
respectively, into the State treasury, and all bills and accounts for costs
of operation and maintenance of, and insurance on, said dormitories,
shall be sent by said institutions, respectively, to the comptroller to be
audited by him and paid by his warrants on the State treasurer, when
found by him to be correct and for proper purposes; provided, how-
ever, that the cost of operation and maintenance, including insurance
premiums, shall not exceed twenty-four hundred dollars per annum
on a dormitory costing one hundred and fifty thousand dollars, or
twenty-eight hundred dollars on one costing two hundred thousand
dollars, and a proportionate cost on less sums expended in building
construction. The rents charged for the use of such dormitories shall
not be less than six dollars ($6.00) per month for each student oc-
cupying a room therein and on the basis of not less than two students
to a room, and the same applies to each student in excess of two to
a room who may occupy any of the rooms.
In the event that the rents derived from said dormitories are not
sufficient to pav off the indebtedness of said institutions, when and as
required by this act, then the amount of such deficiency shall be set
aside by the comptroller out of the other revenue, paid into the State
treasury by such institution on or before the due date of any install-
ment of principal or interest on such certificates.
If at any time default shall be made by any institution in the pay-
ment into the State treasury of the monies hereby required so to be
paid in for interest, principal and sinking fund requirements, the com-
missioners of the sinking fund shall notify the comptroller of this fact,
and he is hereby authorized and directed to draw his warrant upon
the then current annual State appropriation to such institution for the
amount which is then due on account of interest and principal. Such
warrant shall thereupon be honored and such amount disposed of in
the same manner as if it had been paid into the State treasury by such
institution as required by section seven of this act.
The monies so received into the State treasury shall be used by the
commissioners of the sinking fund, first, to pay the interest on such
certificates of indebtedness issued on behalf of such institutions, re-
spectively, when and as it becomes due and payable, and the balance
shall be used to pay the principal thereof. All monies disbursed by the
commissioners of the sinking fund shall be paid out of the State treas-
ury on warrants drawn by the State treasurer and countersigned by the
comptroller.
The purchasers of any of the certificates of indebtedness issued
under this act shall not be required to see to the application of the pur-
chase money. It is provided, however, that in the future not more than
one-third of the investments of the literary fund shall be in college
certificates of indebtedness.
19. All public revenue received into the State treasury within the
two appropriation years provided for in this act (with the exception
of the revenues segregated by law to special purposes), and the balance
of the appropriations made by previous acts of the general assembly
unexpended at the close of business on the twenty-ninth day of Feb-
ruary, nineteen hundred and twenty-eight, which unexpended balances
are hereby declared to be lapsed into the State treasury, are hereby
designated the general fund of the State treasury of the Commonwealth
of Virginia, and shall be used for the payment of the appropriations
therefrom provided for in this act, subject to the limitations and upon
the conditions set out in this act.
No State department, institution or other agency receiving ap-
propriations under the provisions of this act shall exceed the amount of
its appropriations, except in an emergency, and then only with the con-
sent and approval of the governor in writing first obtained; and if
any such State department, institution or other’ agency shall exceed
the amount of its appropriation without such consent and approval of
the governor, there shall be no reimbursement of said excess, nor shall
there be any liability or obligation upon the State to make any appro-
priation hereafter to meet such deficit, and the members of any gov-
erning board of any State department, institution or other agency, or,
if there be no governing board, the head of any State department, 1n-
stitution or other agency, making any such excessive expenditures—
in the case of members of governing boards, who shall have voted
therefor—shall be personally liable for the full amount -of such un-
authorized deficit, and, in the discretion of the governor, shall be deemed
euilty of neglect of official duty, and be subject to removal therefor.
No money shall be borrowed by any State department, institution,
board, or other State agency for the payment of any liability incurred
under this section except on such terms and from such sources as may
be approved by the governor and the State treasurer.
It shall not be lawful for the comptroller to pay any State depart-
ment, institution or other agency any money, except as is provided for
in this act, or in pursuance of some act of the general assembly mak-
ing special appropriation therefor.
20. The proper officer of each State department, institution or
other agency, for which appropriations are made, shall, in his annual
report, give an itemized account of all other sums received by such
department, institution, officer, or other agency from any other source,
and such reports and accounts shall embrace the expenditure of all such
funds; which reports shall be forwarded to the general assembly and
laid before both houses at each session thereof.
Zl. None of the monies mentioned in this act shall be expended
for any other purposes than those for which they are specifically ap-
propriated, and it shall be the duty of the governor, as chief budget
officer of the State, or his deputy, to see that this provision is strictly
observed; and should he find that the said monies are not being ex-
pended in accordance with the provisions of this act, or that the ex-
penditures under any appropriation included in this act are in excess
of the amount necessary to carry out the purpose for which said ap-
propriation was made, he is hereby given the power to restrain the
comptroller from making further disbursements, in whole or in part,
out of said appropriations, to the offending State department, institution,
officer or other agency receiving appropriations under the provisions
of this act; provided, however, that the several appropriations made by
this act may not only be used for the purposes specified in this act,
but authority is hereby given to the governing board of any State de-
partment, institution or other agency, or, if there be no governing board,
to the head of such department, institution or other agency named in
this act, to transfer, within the respective department, institution or
other agency, any such appropriations from the object for which spe-
cifically appropriated or set aside to some other object deemed more
necessary in view of later developments, subject, however, in every
case, to the consent and approval of the governor, in writing, first ob-
tained; and provided, that the total amount appropriated to the re-
spective department, institution or other agency shall in no case be
exceeded; and, further provided, that should such appropriation be
withheld by the governor from any State department, institution, officer,
or other agency, named in this act, or should transfers be authorized
by the governor, as herein provided, he shall set forth fully, in each
case, the reasons for withholding said appropriations or for authorizing
the transfer of said appropriations, as the case may be, in the next
budget submitted to the general assembly, in accordance with law.
It 1s further provided, however, that any State institution may,
with the written consent and approval of the governor first obtained,
spend, in addition to the amount herein appropriated, out of the special
revenues of such institution, any additional special revenues paid into
the State treasury to the credit of such institution, where later develop-
ments are believed to make such additional expenditure necessary.
22. No appropriation made by this act to any society, institution,
board, association or agency not owned or controlled by the State of
Virginia, shall be expended except with the consent and approval of
the head or governing board of the State department or institution here-
in designated, to supervise said expenditures. The payrolls or bills
presented to the comptroller for said expenditures shall be itemized
and classified, in accordance with the budget classification adopted by
the governor, and shall be countersigned by the head or executive officer
of said State department or institution, designated for such purpose,
and lump sum transfers of appropriations to the aforesaid agencies are
hereby prohibited. It shall be the duty of each of said societies, institu-
tions, boards, associations, and agencies to submit its biennial budget
estimates to the head or executive officer of said State department or
institution, for examination and approval, who shall, after final exami-
nation of said estimates, transmit the same to the director of the di-
vision of the budget, with such recommendations as may be considered
necessary or advisable. The accounts of each of the said societies, in-
stitutions, boards, associations, and agencies shall be subject to audit
by the auditor of public accounts, at the direction of the governor.
It shall be the duty of the comptroller to exercise, as herein re-
quired, control and supervision over the expenditures and budget es-
timates of the Confederate Memorial Associations.
It shall be the duty of the State librarian to exercise, as herein
required, subject to the approval of the library board, control and
supervision over the expenditures and budget estimates of the Con-
federate museum at Richmond.
It shall be the duty of the superintendent of public instruction to
exercise, as herein required, subject to the approval of the State board
of education, control and supervision over the expenditures and budget
estimates of the Cooperative Education Association and the Parent-
Teacher Association.
It shall be the duty of the commissioner of agriculture and immi-
gration to exercise, as herein required, subject to the approval of the
State board of agriculture and immigration, control and supervision
over the expenditures and budget estimates of the Virginia State Fair
Association and the Virginia State Horticultural Society.
It shall be the duty of the director of the extension divison of the
Virginia Agricultural and Mechanical College and Polytechnic Institute
to exercise, as herein required, control and supervision over the expendi-
tures and budget estimates of the Virginia Crop Improvement Associa-
tion, the Virginia State Dairymen’s Association, and the Virginia State
Poultry Federation.
It shall be the duty of the commissioner of public welfare to exer-
cise, as herein required, subject to the approval of the State board of
public welfare, control and supervision over the expenditures and
budget estimates of the Home for Needy Confederate Women, the sev-
eral travelers’ aid societies receiving appropriations from the State of
Virginia and the Virginia Home for Incurables.
23. All the appropriations herein made out of the general fund
of the State treasury for the period of four months, beginning March
1 and ending June 30, 1930, and for the two years ending, respectively,
on June 30, 1931, and on June 30, 1932, unexpended on the books of
the division of accounts and control at the close of business on June
30, 1932, shall revert to and become a part of the general fund of the
State treasury of the Commonwealth of Virginia, and shall not there-
after be paid by the comptroller and the same shall be charged off upon
the books of his office, provided, however, that such unexpended bal-
ances shall be continued in force for such period not to exceed ten
days from June 30, 1932, as may be necessary in order to permit the
payment of any claims, demands or liabilities incurred prior to June
30, 1932, and unpaid at the close of business on that date and shown
by audit in the division of accounts and control to be a just and legal
charge against any such unexpended balance.
24, All acts and parts of acts inconsistent with the provisions of
this act be, and the same are hereby, repealed.
25. This act shall be in force from its passage.
