Chap. 48.—An ACT to permit the erection of a dam across the mouth of any
creek in any county of Virginia, adjoining a city located on navigable water
and having a population of thirty thousand or more inhabitants by the United
States census, which dam is erected for the purpose of creating a lake to
be used in connection with a marine museum. [S B 263]

1. Be it enacted by the general assembly of Virginia, That any
person is authorized to erect a dam across the mouth of any creek in
any county in Virginia, adjoining any city located on navigable water,
which city has a population of thirty thousand or more inhabitants by
the last United States census for the purpose of constructing a marine
museum and park. The lake created by such dam and the land ad-
joining used for the park purposes shall not exceed one thousand acres.
Before erecting such dam, the person desiring to do so, shall apply to
the governor for permission to construct a dam across said stream
and it shall be the duty of the governor, if satisfied that the dam is
to be erected for the purpose of creating a lake to be used in connection
with the establishment of a marine museum, and that the lands to be
flooded thereby are wholly owned or leased by the person making said
application, and that no public highway will be flooded thereby to
forthwith grant a permit to the applicant to erect such dam; provided,
however, that the State highway commission shall be given reasonable
written notice of any such application, and an opportunity to be heard
before the governor thereon.
