Chap. 434.—An ACT to provide for an appropriation of $500.00 to compensate
E. C. Burks, Commonwealth’s attorney of Bedford county, for his services
in prosecuting a certain ouster proceeding in Franklin county. [IS B 242]

Whereas, in the month of February, nineteen hundred and twenty-
eight, Honorable P. H. Dillard, iudge of the circuit court of Franklin
county appointed E. C. Burks, Commonwealth’s attorney of Bedford
county, to represent the Commonwealth in an ouster proceeding in the
said circuit court of Franklin county, against J. P. Hodges, sheriff
of said county, the Commonwealth’s attorney of that county being so
situated that it was improper for him to act; and,
Whereas, the said EK. C. Burks, did prosecute said proceeding, and
in doing so, he was required to make several trips from Bedford to
Roanoke and Rocky Mount for conferences with other attorneys in
the case, and for the trial of the case, which consumed several days
beginning on April ninth, nineteen hundred and twenty-eight, and it
was agreed by Judge Dillard and other counsel in the case, that the
sum of five hundred dollars ($500.00) would be a reasonable fee to be
paid Mr. Burks for his services in the case; and
Whereas, it appeared that there was no statutory provision whereby
such fee could be paid, for which reason, it is necessary to apply to
the general assembly for relief in the premises; now, therefore,
1. Be it enacted by the general assembly of Virginia, That there
be, and is hereby appropriated out of any funds in the State treasury
not otherwise appropriated, the sum of five hundred dollars to com-
pensate the said E. C. Burks for his services in prosecuting the afore-
said ouster proceeding, and that the comptroller issue his warrant on
the State treasurer, payable to the said E. C. Burks, for the said sum
of five hundred dollars.
