Chap. 424.—An ACT to amend and re-enact chapter 494 of the acts of assembly
of Virginia of 1926, authorizing co-operation on the part of the proper
authorities of the State of Virginia in respect to construction of boulevards
or highways in the State of Virginia, or widening or improving existing
highways of the United States government. [S B 365]

1. Be it enacted by the general assembly of Virginia, That chap-
ter four hundred and ninety-four of the acts of assembly of nineteen
hundred and twenty-six (page eight hundred and forty-five) be
amended and re-enacted so as to read as follows:
Whereas, it is contemplated that the congress of the United States
may provide for the establishment of a boulevard from the city of
Washington to Mount Vernon, the home of George Washington, in
Fairfax county, and may also provide for the establishment of other
boulevards and highways extending into the State of Virginia; or
widening or improving existing highways;
Whereas, it is desired to make provision by the State of Virginia
to cooperate with the national government in any such undertaking,
now, therefore,
Section 1. Be it enacted by the general assembly of Virginia, as
follows: The United States government, or any duly authorized rep-
resentatives of said government or any commission now or hereafter
established by the congress of the United States for any such pur-
pose is given the right of acquisition of title fee simple or such
other estates or interests therein as may be desired by purchase or
condemnation of lands in the State of Virginia for. any of the pur-
poses aforesaid, the proceedings therein, when condemnation is re-
sorted to, shall conform as near as may be to the proceedings author-
ized by chapter four hundred and seventy-two of the nineteen hundred
and twenty-eight acts of the general assembly of Virginia (acts of the
nineteen hundred and twenty-eight general assembly of Virginia, pages
twelve hundred and twenty-eight, twelve hundred and twenty-nine and
twelve hundred and thirty), empowering the State highway com-
missioner of Virginia to condemn lands for State highway purposes;
provided, that in addition to the exercise of the power of eminent do-
main as hereinbefore provided, the United States government or any
duly authorized representatives of said government, or any commission
now or hereafter established by the congress of the United States,
is hereby authorized to enter upon and take possession of such lands
and rights of way as it may deem necessary for the purposes of this
act and to proceed with the construction of such highway over and
through such lands without having first condemned the same; pro-
vided, further, that within sixty days after taking possession of such
lands and rights of way, if the United States and the owner or owners
thereof have been unable to agree upon just compensation therefor,
condemnation proceedings shall be instituted as hereinabove provided.
Section 2. That concurrent jurisdiction over any such lands or
interests or estates therein acquired by condemnation or otherwise, is
hereby ceded to the government of the United States, in accordance
with the provisions of the sections of the Code of Virginia already
in force, ceding to the United States government concurrent juris-
diction over certain lands within the State of Virginia.
Section 3. That the council of any city or town, and the board
of supervisors of any county in this State, concerned in such pro-
posed boulevards or highways, are hereby authorized, jointly or sev-
erally, to contribute in whole or in part to the financing of sucn
acquisition of titles and are hereby given the power, jointly or sev-
erally, to contract with the United States government or its authorized
representatives, or commission, now or hereafter so authorized or
established, in reference to any such boulevards or highways, as to
any matter included in the intendment of this act.
Section 4. Should any part of this act be held unconstitutional it
shall nevertheless continue in full force and effect as to the provisions
thereof which are constitutional.
Z. An emergency existing, this act shall be in force from its
passage.
