Chap. 370.—An ACT to provide for the relief of volunteer firemen of Fairfa:
county killed or injured while engaged in fighting fires or in going to o
returning therefrom. [fH B 314

Be it enacted by the general assembly of Virginia, That financia
relief shall be extended by the county of Fairfax to volunteer firemer
who are killed or injured while engaged in fighting fire, while re.
sponding to an alarm or returning from the scene of a fire, such relie!
to be paid in amounts and manner as hereinafter set forth.
2. The board of supervisors is hereby empowered to insure against
the hazards imposed by this act, and the cost of insurance may be
payable out of the proceeds of any levy imposed for fire protectior
for the purpose of this act.
3. For the purposes of this act the term volunteer fireman shall
include only members of any organized fire-fighting company which
has in its possession and operates fire fighting apparatus and equip-
ment, whose members serve without pay and whose names have been
duly certified by the secretary of such company as active members
thereof to the clerk of the circuit court of said county. The clerks
shall keep a complete and accurate record of all names so certified in
a book provided by the governing body of said county. Names shall
be added to or stricken from said record upon the certificate of the
secretary of any such company that such action has been decided by his
organization in due form.
4. Should any volunteer fireman be killed while actually engaged
in fighting fire, or while going to a fire in answer to an alarm or return-
ing therefrom, the board of supervisors of the county, shall pay to
his personal representative for the benefit of his estate the sum of
thirty-five hundred dollars.
5. Should any volunteer fireman be injured under circumstances
set forth in section four hereof, so as to be totally and permanently
lisabled from making a livelihood he shall be paid in like manner the
sum of fifty dollars per week for seventy weeks.
6. Should a volunteer fireman be injured under circumstances set
orth in section four hereof, so as to be prevented from attending to
1is usual occupation for a period greater than two weeks (but not
ermanently and totally disabled), he shall be paid in like manner the
um of twenty-five dollars per week until able to return to his usual
ccupation, provided, however, that said payments shall not continue
n any event for a period greater than forty weeks. In the event that
ny such volunteer fireman be injured as hereinbefore set forth so as to
prevented from attending to his usual occupation for a period of
ess than two weeks, he shall be paid in like manner the sum of two
lollars and fifty cents per day until he is able to return to his usual
yecupation.
7 Tn addition to the relief set forth in sections four, five and Six,
ull necessary hospital charges and all necessary and proper medical,
surgical, laboratory and operating room charges for any volunteer
freman arising out of any injury set forth in sections four, five and
six shall be paid by said county.
8. Any disputed question of fact arising under the operation of
this act shall be triable before the board of supervisors of the county
and from the decision of said board both the petitioner and the county
shall have an appeal of right to the circuit court of said county, such
appeal on behalf of the county to be taken by the attorney for the
Commonwealth who shall prosecute the same in the trial court.
9, This act shall not become effective unless and until the board
of supervisors shall adopt and approve the same by resolution duly
passed, and spread on its minutes.
10. An emergency existing, this act shall be in force from its pas-
sage.
