Chap. 295.—An ACT to amend and re-enact section 4697 of the Code of Vir-
ginia, relating to the selling or giving away of toy firearms. [S B 321]

1. Be it enacted by the general assembly of Virginia, That section
forty-six hundred and ninety-seven, of the Code of Virginia, be
amended and re-enacted so as to read as follows:
Section 4697. It shall be unlawful for any person, firm, corpora-
tion, or association, to sell, barter, exchange, furnish, or dispose of by
purchase, gift, or in any other manner, any toy gun, pistol, rifle, or
other toy firearm, if the same shall, by means of powder or other ex-
plosive, discharge blank or ball charges. Any firm, corporation, or
association violating the provisions of this section shall be deemed
guilty of a misdemeanor, and, upon conviction thereof, shall be fined
not less than fifty dollars nor more than one hundred dollars, or con-
fined in jail for a period not less than thirty nor more than ninety days,
or both. Each sale of any of the articles hereinbefore specified to any
person shall constitute a separate offense.
Nothing in this section shall be construed as preventing the sale of
what are commonly known as cap pistols.
