Chap. 270.—An ACT to amend and re-enact section 4730 of the Code of Vir-
ginia, in relation to public roads, so as to prohibit the erection or mainte-
nance of any structure that would obstruct the view at road and railway
crossings, and to prescribe penalties for violations. [S B 234]

1. Be it enacted by the general assembly of Virginia, That section
forty-seven hundred and thirty of the Code of Virginia be amended
and re-enacted so as to read as follows:
Section 4730. If any person kill a tree within the distance of
fifty feet of a road, or so cut or injure it as to render it liable to fall,
and leave it standing;
Or knowingly and wilfully, without lawful authority, break down,
destroy, or injure any bridge, bench or log placed across a stream for
the accommodation of pedestrians, or any sign board, milestone, or
post, for the direction of travelers ;
Or obstruct any road or any ditch made for the purpose of draining
any such road;
Or wilfully ride any horse, mule or other animal, upon any side-
walk, constructed of any material other than dirt or earth, along any
highway through any unincorporated village ;
Or erect, or maintain any bill board, advertising, or other similar
structure outside the corporate limits of a city or town within a iadius
of two hundred feet from the point of intersection of any two or more
public roads, or the intersection of a public road and a railroad, in the
direction of the intersecting road or roads and railroads, or to erect
or maintain any such bill board, advertising or other similar struc-
ture at or near any curve or bend in a public road, outside the corporate
limits of any incorporated city or town, in such manner, as to obstruct
the clear view, or cross the line of vision of pedestrians and/or persons
in wheeled vehicles looking from any one point to any other point on
any such road not more than one hundred yards apart; he shall be
guilty of a misdemeanor.
The provisions of this act shall not limit or restrict the right of
any common carrier to erect and maintain markers, of such design as
may be approved by the corporation commission, at any point located
off the right of way of any highway, in this State, to designate stopping
points, fare zones, or schedules, nor shall it limit or restrict any ferry
company or toll bridge company from erecting and maintaining direc-
tion markers or other advertisement, of such design as may be ap-
proved by the chairman of the State highway commission located off
the right of way of any highway of this State.
