Chap. 206.—An ACT to amend and re-enact section 19 of chapter 8 of chapter
819 of the acts of assembly of 1898, entitled an act to provide a new charter
for the town of Berryville, in relation to exempting said town from the pay-
ment of certain road taxes. [H B 193]

1. Be it enacted by the general assembly of Virginia, That section
nineteen of chapter eight of chapter eight hundred and nineteen of the
acts of assembly of eighteen hundred and ninety-eight, entitled an act
to provide a new charter for the town of Berryville, be amended and
re-enacted so as to read as follows:
Section 19. The said town and the taxable persons and property
therein shall be exempt and free from the payment of any poor-rates
or road tax, and from contributing to any county expenses for any year
in which it shall appear that said town shall, at its own expense, provide
for its own poor and keep its streets in order; provided, however, that
the property in the town, subject to local taxation, shall be exempt from
levy of any kind by Clarke county; provided, however, that the coun-
cil of said town shall annually levy a tax on all such property, in addi-
tion to the levy necessary for town purposes, sufficient to raise a net
amount equal to one-half of the gross amount that would be produced
by laying the current general county levy of said county, on said prop-
erty, and shall pay such net sum, when the amount thereof shall be
definitely ascertainable into the treasury of the county; and provided
further that the property in said town subject to local taxation shall
be subject to the payment of the county school levy so long as pupils
residing in said town attend the public schools of said county, and
shall also be subject to the payment to the same rate of taxation to the
county not to exceed ten cents on the one hundred dollars of assessed
valuation as may be levied by the said county for the purpose of pay-
ing the interest and/or retiring the principal of the existing outstanding
county railroad bonds and county bridge bonds and any and all re-
newals or refunding bonds issued therefor.
2. An emergency existing, this act shall be in force from its
passage.
