Chap. 171.—An ACT to amend and re-enact sections 3, 4, and 5 of chapter 321
of the acts of assembly of 1928, entitled an act to provide for a special
police force for the county of Fairfax, appointment and compensation, ap-
proved March 21, 1928. [H B 362]

1. Be it enacted by the general assembly of Virginia, That sec-
tions three, four, and five of chapter three hundred and twenty-one of
the acts of assembly of nineteen hundred and twenty-eight be amended
and re-enacted so as to read as follows:
Section 3. Such person or persons so appointed shall be conserva-
tors of the peace. Compensation may, subject to the approval of the
board of supervisors of said county, be allowed such policemen, not
to exceed the rate of eighteen hundred dollars per year, to be paid out
of the general county fund, which compensation shall be fixed by the
sheriff, subject to the approval of the circuit court of the said county,
or the judge thereof in vacation.
Section 4. If any policeman is appointed, as provided herein, upon
the application of any person, firm or corporation, operating any indus-
trial establishment, or place of entertainment, or amusement, and for
the sole purpose of protecting such establishment or place of entertain-
ment or amusement, in said county, the compensation of such police-
man shall be paid by the person, firm or corporation applying for the
appointment, provided that no such appointment shall be made except
upon written application thereof. No policeman appointed and serving,
as in this section is provided, shall be deemed to be the employee of
the State or county within the meaning of the Virginia workmen’s
compensation act. |
Section 5. (a) All policemen appointed, as provided for herein,
shall be removable by the sheriff making the appointment at his pleasure.
(b) The board of supervsiors of said county shall appropriate at
all times a salary of not more than twelve hundred dollars per annum
for one deputy sheriff and upon the certificate of the sheriff filed in
writing with said board that it is necessary for the conduct of his office
that he shall have two paid deputies, the said board of supervisors
shall make a further appropriation of not exceeding twelve hundred
dollars per annum to provide the salary necessary for the additional
deputy. |
