1. Be it enacted by the general assembly of Virginia, That th

Out of this appropriation shall be paid the salaries of
members, clerks, assistant clerks, officers, pages and em-
ployees; the mileage of members, officers and employees,
including the salaries and mileage of members of legisla-
tive committees sitting during the recess; and the inci-
dental expenses of the general assembly, not exceeding the
sum of twelve hundred dollars each for the senate and
house of delegates, and to pay any deficit in the con-
tingent fund in the two houses, a sum sufficient.
It is further provided that out of this appropriation
there shall be paid the clerk of the senate, the sum of
twelve dollars per day, and the clerk of the house of dele-
gates the sum of twelve dollars per day, and the clerk of
the senate and clerk of the house of delegates shall each
receive an additional sum of ten dollars per day for thirty
days before, during and for sixty days after each regular
session, and for ten days before, during and for thirty
days after each special or extra session, and this schedul
of compensation shall apply to the present and subsequen
sessions of the general assembly. The offices of the clerk:

except on Sundays and legal holidays, a sum sufficient.

Out of this appropriation shall be paid to each pen-
sioner in the several classes now on the pension roster,
or hereafter placed on the pension roster, who is entitled,
under the act to appropriate public revenue, approved
March 9, 1928, (acts of general assembly, 1928, chapter
110), to $320.00 a year, for total blindness, $540.00 a year;
to $200.00 a year for total disability, $360.00 a year; and
to each widow of a soldier, sailor or marine, who was mar-
ried prior to January 1, 1890, and who is otherwise entitled
under this act to a pension, $120.00 a year, and to such
widow who is blind, $240.00 a year and to each widow of a
Confederate soldier married on or after January 1, 1890,
who is over 75 years of age, $120.00; and to soldiers proven
to be totally deaf by certificate of a reputable practicing
physician and affidavits by two reputable unrelated dis-
interested citizens, who are fully acquainted with the ap-
plicant, $540.00 a year; and to the personal representative
of each deceased pensioner $50.00 for the funeral expenses
of such deceased pensioner, provided however that the
said sum of $50.00 may be paid without the qualification
of a personal representative to the undertaker, when such
undertaker shall file his bill, verified by proper affidavit
with the comptroller together with copy of death cer-
tificate of such pensioner, and the allowance as authorized
by the act aforesaid: provided, further, that under the
provisions of this act any person who actually accompanied
a soldier in the service and remained faithful and loyal as
the body servant of such soldier, or who served as cook,
hostler or teamster, or who worked on breastworks under
any command of the army and thereby rendered service to
the Confederacy shall be entitled to receive an annual
pension of $96.00, proof of service to be prescribed by the
comptroller.
Any unexpended portion of this appropriation shall
revert to the general fund of the State treasury and no part
thereof shall be prorated among pensioners.
And it is further provided that out of the appropriation
for public printing, the director of the division of purchase
and printing shall supply all forms and have done and pay
for all printing, binding, ruling, etc., required by the comp-
troller in pension matters, and in connection with the pay-
ment of pensions. The comptroller shall pay monthly at
such dates as he may prescribe, the pensions authorized by
this act.
It is further provided that out of this appropriation of
$373,983, there shall be expended for relief of needy Con-
federate women of Virginia, who are not upon the State
pension roster, and who are not inmates of any Confed-
erate, independent or church home or charitable institution,
in accordance with the provisions of the act approved
March 10, 1914 (acts of assembly, 1914, chapter 56, page

Virginia Manual Labor School for Colored Boys (acts of
assembly, 1920, chapter 344, pages 515-516), as provided
by an act approved February 5, 1900 (acts of asseinbly,
1899-1900, chapter 273, section 6, page 302), cost of main-
tenance in local jails of persons charged with violation of
State laws, including food, clothing, medicine, medical at-
tention, guarding, etc.; provided, however, that all jail
physicians be paid at the rate provided by law, but not
more than five hundred dollars per calendar year shall be
paid the jail physician or physicians for any city or county;
and coroner’s fees, etc.; said compensation for jail physi-
cian to be paid at the end of the calendar year; provided,
however, that in case of death or resignation his compensa-
tion shall be prorated on the basis the time of service bears
to the full calendar year.

priation shall be used for the payment of criminal charges
incident to prisoners employed on the State convict road
force, or the transportation costs of prisoners committed
to the custody of the Virginia Industrial School for Boys
(acts of assembly, 1920, chapter 76, pages 64-66).

It is hereby provided that all fees and licenses collected
by the division of motor vehicles for licensing motor
vehicles and for issuing and registering certificates of title
thereto and all taxes collected by the division of motor
vehicles on motor vehicle fuels, including, in addition to all
other fees, licenses, and taxes, all monies received by the
division of motor vehicles under the provisions of the act
which became a law July 1, 1924 (acts of assembly, 1924,
chapter 368, pages 523-532), relating to the protection of
titles to motor vehicles and to the purchase, sale and stor-
age thereof, after the close of business, February 28, 1930,
together with any funds previously collected for these pur-
poses and still unexpended in the hands of the division of
motor vehicles as of said date, shall be paid directly and
promptly into the State treasury, to the credit of the State
highway maintenance and construction fund, without de-
ductions of any kind being made therefrom; and it is pro-
vided, further, that all funds held within the State treasury
to the credit of the automobile theft fund at the close of
business on February 28, 1930, shall be promptly trans-
ferred to the credit of the said State highway maintenance
and construction fund, and the said automobile theft fund
is hereby abolished; and it is further provided that the
funds herein appropriated for licensing and registering
motor vehicles and recording titles thereto, for collect-
ing the taxes on motor vehicle fuels, for field inspection,
and for carrying out the other duties imposed by law
upon the division of motor vehicles, shall be paid out of
the State highway maintenance and construction fund by
warrants drawn on the comptroller by the division of
motor vehicles.
Provided, however, that nothing in this act shall in-
terfere with the distribution of the revenue from the one
and one-half cent tax per gallon on motor vehicle fuels to
the several counties of the State, in accordance with the
provisions of the act approved March 26, 1923 (acts of as-
sembly, 1923, extra session, chapter 107, pages 125-129, as
amended).
There is hereby “appropriated out of the motor vehi-
cle fuel tax funds in the State treasury the sum of $234.55
to pay the judgment of the Virginian Railway Company
against the Commonwealth amounting to $234.55, rendered
by the circuit court of the city of Richmond; and the comp-
troller is directed to issue his warrant on the State treas-
urer in favor of the Virginian Railway for said sum

It is provided that out of this appropriation shall be
paid the salaries of the interior and exterior guards of the
Penitentiary, each at a basic rate of compensation of not
less than $1,200 per annum, with such additional amounts
as the board of directors of the Penitentiary may deter-
mine, within the limits of this appropriation, not exceeding
$1,500 per annum in any case; no guard, however, shall be
paid when absent on furlough for more than fifteen days in
any one year, whether sick or otherwise; and, provided,
further, that guards regularly employed at night shall be
allowed two Sundays off with pay each month, in accord-
ance with law, and that substitute guards shall receive pay
for the time actually employed at the basic rate of com-

Out of this appropriation shall be paid to each pensioner
in the several classes now on the pension roster, or hereafter
placed on the pension roster, who is entitled, under the act to
appropriate public revenue, approved March 9, 1928 (acts of
general assembly, 1928, chapter 110), to $320.00 a year, for
total blindness, $540.00 a year; to $200.00 a year for total
disability, $360.00 a year; and to each widow of a soldier, sail-
or or marine, who was married prior to January 1, 1890, and
who is otherwise entitled under this act to a pension, $120.00
a year, and to such widow who is blind, $240.00 a year and
to each widow of a Confederate soldier married on or after
January 1, 1890, who is over 75 years of age, $120.00; and to
soldiers proven to be totally deaf by certificate of a reputable
practicing physician and affidavits by two reputable unrelated
disinterested citizens, who are fully acquainted with the appli-
cant, $540.00 a year; and to the personal representative of each
deceased pensioner $50.00 for the funeral expenses of such de-
ceased pensioner; provided, however, that the said sum of
$50.00 may be paid without the qualification of a personal
representative to the undertaker, when such undertaker shall
file his bill, verified by proper affidavit with the Comptroller
together with copy of death certificate of such pensioner, and
the allowances as authorized by the act aforesaid; provided,
further, that under the provisions of this act any person who
actually accompanied a soldier in the service and remained
faithful and loyal as the body servant of such soldier, or who
served as cook, hostler or teamster, or who worked on breast-
works under any command of the army and thereby rendered
service to the Confederacy, shall be entitled to receive an an-
nual pension of $96.00, proof of service to be prescribed by
the Comptroller.
Any unexpended portion of this appropriation shall revert
to the general fund of the State treasury, and no part thereof
shall be prorated among pensioners.
It is further provided that out of the appropriations for
public printing, the director of the division of purchase and
printing shall supply all forms and have done and pay for all
printing, binding, ruling, etc., required by the comptroller in
pension matters and in connection with the payment of pen-
sions. The comptroller shall pay monthly at such dates as he
may prescribe the pensions authorized by this act.
It is further provided that out of this appropriation of one
million dollars there shall be expended for relief of needy
Confederate women of Virginia, who are not upon the State
pension roster, and who are not inmates of any Confederate,
independent or church home or charitable institution, in accord-
ance with the provisions of the act approved March 10, 1914

however, that all jail physicians be paid at the rate provided
by law, but not more than five hundred dollars per calendar

It is hereby provided that all fees and licenses collected by
the division of motor vehicles for licensing motor vehicles and
for issuing and registering certificates of title thereto and all
taxes collected by the division of motor vehicles on motor
vehicle fuels, including in addition to all other fees, licenses,
and taxes all monies received by the division of motor vehicles
under the provisions of the act, which became a law July 1,
1924 (acts of assembly, 1924, chapter 368, pages 523-532),
relating to the protection of titles to motor vehicles and to the
purchase, sale and storage thereof, after the close of business
February 28, 1930, together with any funds previously collected
for these purposes and still unexpended in the hands of the
division of motor vehicles as of said date, shall be paid di-
rectly and promptly into the State treasury to the credit of the
State highway maintenance and construction fund, without de-
ductions of any kind being made therefrom; and it is provided,
further, that all funds held within the State treasury to the
credit of the automobile theft fund at the close of business

the rules and regulations of the State board of education for
the establishment and maintenance of rural one-room and
two-room and graded schools, and for the special supervision

$780,000.00, provided any amount of this sum of $780,000.00
segregated for vacation schools may be used in cities as well
as in counties.
Out of this sum of $780,000.00 segregated to the establish-
ment and maintenance of rural elementary schools, the State
board of education may use not exceeding $20,000 for the
establishment and maintenance of vacation schools in such
sections of the State as the State board of education may
deem wise and proper. Any unused balance of this sum shall
revert to and become a part of the elementary fund.
It is provided that the entire monies in this whole appro-
priation of $5,344,190, except as otherwise provided, shall be
apportioned by the State board of education as prescribed by
section 135 of the Constitution of Virginia, on a basis of
school population, to the public free schools of the
several counties and cities of the Commonwealth; provided,
further, however, that the said State board of education shall
not apportion any of the said funds to any county or city
unless said county or city pay out of local funds at least
twenty per centum of the teachers’ salaries in the said county
or city; and provided, further, however, that in exceptional
cases the State board of education may except from this rule
a county which is unable to pay more than ten per centum
of the teachers’ salaries.
It is further provided that out of this appropriation of
$5,344,190, there is hereby appropriated:
For the cooperative education association of

Provided, further, that said cooperative education associa-
tion of Virginia and the said parent teacher association shall

It is further provided that the State board of education
may, in its discretion, permit the cooperative education associa-
tion of Virginia and the parent teacher association to make
expenditures out of this appropriation of $5,344,190.00 in excess
of these respective amounts of $3,500.00 and $2,500.00 to the
extent, if any, that the board may consider such additional
expenditures advisable.
It is further provided that out of the appropriation of

The superintendent of public instruction shall receive as
an additional salary the sum of $1,000.00, to be paid out of
this appropriation for vocational education.
The State treasurer shall receive as additional compensa-
tion to the salary fixed by this act the sum of $1,000.00 per
annum out of this appropriation for vocational education, for
the custody of the funds and other additional duties imposed
upon him by law, effective March 1, 1928.
It is provided that no Virginia teacher shall be charged
tuition in normal schools or institutes, receiving support out
of this appropriation; and it is further provided that no part
of this appropriation shall be turned over to any educational
institution receiving appropriations from the State for main-
tenance of summer schools.

No member of the board of directors of the Peniten-
tiary shall hereafter receive any per diem for his services, but
each member of the board living outside of the city of Rich-
mond shall be entitled to be reimbursed for his actual travel-
ing and hotel expenses incurred in attending meetings of the
board, to be paid out of this appropriation of $318,520.00.
It is provided that out of this appropriation shall be paid
the salaries of the interior and exterior guards of the Peniten-
tiary, each at a basic rate of compensation of not less than
$1,200 per annum, with such additional amounts as the board
of directors of the Penitentiary may determine, within the
limits of this appropriation, not exceeding $1,620 per annum
in any case; no guard, however, shall be paid when absent
on furlough for more than fifteen days in any one year,
whether sick or otherwise; and provided, further, that guards
regularly employed at night shall be allowed two Sundays
off with pay each month, in accordance with law, and that
substitute guards shall receive pay for the time actually em-
ployed at the basic rate of compensation, not exceeding $1,200

thousand dollars. The said committee shall receive no com-
pensation for their services.
It is provided, further, that the appropriation of five thou-

War Memorial Commission

This fund is appropriated out of moneys in the State treas-
ury not otherwise appropriated available after September first,
nineteen hundred and thirty-one, and to be disbursed by the
State treasurer on warrants of the comptroller issued on
vouchers signed by the chairman of the war memorial commis-
sion, countersigned by its secretary, subject to the following
qualifications: That no appropriation hereby made shall be-
come available for expenditure unless and until the said war
memorial commission shall have raised or caused to be raised,
by popular subscription or otherwise, at least the sum of sev-
enty-five thousand dollars for the purpose of the purchase of
the bells for the carillon; and unless and until provision for
the perpetual upkeep and maintenance of the war memorial
shall have been made by the city of Richmond or by private
persons or associations, either or both giving such guarantee as
shall be satisfactory to the governor, approved by the attorney
general.
When the conditions set out in the preceding paragraph of
this act shall have been met, the war memorial commission shall
enter into contracts for, and begin the construction of, the me-
morial, which contracts shall be binding upon the State within
the limits of the appropriation of seventy-five thousand dollars
made by this act to the said war memorial commission, plus the
sum of one hundred and seventy-five thousand dollars.
