Chap. 100.—An ACT to amend and re-enact section 14 of chapter 465 of the
acts of the general assembly of Virginia, session of 1901-1902, chartering
the town of Wakefield. [H B 8&2]

1. Be it enacted by the general assembly of Virginia, That sec-
tion fourteen of chapter four hundred and sixty-five of the acts of th
general assembly of Virginia, session of nineteen hundred and one
nineteen hundred and two, be amended and re-enacted so as to read a:
follows:
Section 14. The mayor shall, by virtue of his office, possess al.
the power, authority, and jurisdiction of a justice of the peace of Sussex
county. He shall appoint assistant sergebnts whenever the peace anc
good order of the town, in his opinion, may require it, and see that
all ordinances of the town are fully enforced. In case a vacancy shal!
occur in the office of mayor, from any| cause, the president of the
council shall perform all the duties of the office until such vacancy is
filled by an election of the council for the unexpired term.
The mayor may, with the approval of the council, entered of record
on the book containing the minutes of the council meetings, appoint
a trial justice for said town, who shall, by virtue of said office, possess
all the power, authority and jurisdiction of a justice of the peace, and
whose term of office shall be concurrent with that of the mayor. Before
entering upon the discharge of any duty, the person so appointed shall
qualify by the taking and subscribing the|oaths prescribed by law for
a justice of the peace, before some officer authorized and empowered
to administer oaths, and a minute thereof shall be entered upon the
minute book of said council. The compensation of such trial justice
shall be determined by the council, and may be paid by the fees col-
lected by him, or a salary to be fixed by) the council, payable out of
the town treasury, either or both, or it may be by salary only, in
which case the fees collected by him shall be properly accounted for
and turned into the town treasury.
2. An emergency existing, this act |shall be in force from its
passage.
