Chap. 546.—An ACT to amend and re-enact section 39 of an act entitled an act
to raise revenue for the support of the government and public free schools,
and to pay the interest on the public debt, and to provide a special tax for
pensions as authorized by section 189 of the Constitution, approved April 16,
1903, as heretofore amended. {S B 218}

1. Beit enacted by the general assembly of Virginia, That section
thirty-nine of an act entitled an act to raise revenue for the support of
the government and public free schools, and to pay the interest on the
public debt, and to provide a special tax for pensions, as authorized
by section one hundred and eighty-nine of the Constitution, approved
April sixteenth, nineteen hundred and three, as heretofore amended,
be amended and re-enacted so as to read as follows:

an amount equai to the Gierence Letween the amount already paid
on the original charter and the amount required by this act to be paid
on tbe amended or revised charter, and upen the amendment, re-
Vision, or extension of anv charter. Gumestic or foreign. if no fee was
paid to this State on the original charter, the amount to be paid shall
be the same as would have tv be paid on an onginal charter.
Upon the amendment or extension of a charter of a transportation
OF transmission company, or any other public service company, in the
event that the charter tee paid on the orizinal charter and anv prior
amendment sha:l be less than the amount of charter fee required to be
paid on an original charter of that character bv the terms of this act,
then a charter fee shall be paid on the amended charter equal in
amount to the difference het een the charter fee already paid on the
original charter and any prior amendments thereof and the amount
required by this act to be paid on the maximum amount of authorized
capital stock provided for in the charter of said corporation at the
ume of such amendment.
Upon the merger or consolidation of two or more corporations in
the manner provided for hy the laws of this State, whenever one of the
Corporations so merging or consolidating is a foreign corporation, then
a Charter fee shall be paid. as provided for in this act, upon the amount
of capital stock proposed to be issued by the new or consolidated cor-
poration taken as the maximum capital stock for the purpose of es-
timating said charter fee.
