Chap. 540.—An ACT to amend and re-enact section 5349 of the Code of Virginia,
as amended by an act approved March 7, 1922, and to repeal section 5348 of
the Code, in relation to the transfer of property in this State belonging to
non-resident decedents. [H B 430]
Approved March 25, 1926.
1. Beit enacted by the general assembly of Virginia, That section
fifty-three hundred and forty-nine of the Code of Virginia, as amended
by an act approved March seventh, nineteen hundred and twenty-two,
be amended and re-enacted so as to read as follows:
Section 5349. Transfer of property of non-resident decedents;
notice.—The stock, bonds, or certificates of debt of this State, and of
any corporation created by it, and of any national bank having its
principal office in this State, standing in the name of a decedent
domiciled at the time of his death out of this State, and who is not
known by the officer or agent charged with the duty of transferring
such stock, bonds or certificates, to have a personal representative
qualified as such within the same, may be transferred by the executor
or administrator of such decedent qualified according to the laws of
the Comicile, when afhdavit shall have been filed as hereinafter pre-
scribed.
There shall be filed-with such officer or agent as is hereinbefore
mentioned, the affidavit of some credible person that notice of the
proposed transfer has been published once a week for two weeks in
some newspaper published in the county or city, or having general
circulation therein, in which are kept the books upon which the trans-
fer is proposed to be made, and was posted at the front door of the
courthouse of such county, or city, two weeks before the time of mak-
ing such affidavit. But if before such transfer be actually made a
notice in writing forbidding the same be served on such officer or agent,
such transfer only shall be made as would have been lawful if this
section had not been enacted.
2. Section fifty-three hundred and forty-eight of the Code of
Virginia is hereby repealed.
