Chap. 468.—An ACT to prohibit the taking of fish from the streams of Giles
county except with hook and line, and to prohibit the taking of fsh from
certain streams in said county, during certain seasons; to prohibit fishing
on Sunday; to prohibit the use of fish berries, dynamite and other explosive
or chemical substances for the taking, or destruction of fish; and to pre-
scribe the punishment for violations thereof. [H B 161]
Approved March 24, 1920.
1. Beit enacted by the general assembly of Virginia, That it shall
be unlawful for any person at any time, to fish for, or take fish of any
kind from any of the streams of Giles county, except as hereinafter
provided, in any way except by hook and line in the usual and ac-
cepted sense of angling, hook and line to be construed to include trot
line.
2. That it shall be unlawful for any person to fish for, or take fish
from the streams of Wolk creek, above the mill dam at Narrows,
Walkers creek, and Sinking creek, below Zells mill, between the first
day of January and the first day of July, except that permission may
be given by the department of game and inland fisheries, under the
supervision of the regular warden, to seine, gig, or shoot carp.
3. That it shall be unlawful for any person to fish for, or take fish
from the streams of Big Stony creek, Little Stony creek, Johns creek,
Dismal creek, Nobusiness creek and Mill creek, or Dry branch, or
from any tributary of any of said streams, between the first day of
July and the first day of April.
4. That it shall be unlawful for any person to use any fish berries,
lime, dynamite, or any other chemical or explosive of any kind, for
the taking or destruction of fish in any of the waters of Giles county.
5. That it shall be unlawful for any person to fish for, or take fish
in any stream in Giles county on a Sunday.
6. The provisions of this act shall not apply to the taking of
minnows for bait (except trout and bass), by the use of a net or seine
not exceeding six feet in length.
6-a. It shall be unlawful to take minnows from any streams in
Giles county by a net or seine on Sunday.
7. Any person violating any of the provisions of sections one,
two, three or five of this act, or either one of them, shall be deemed
guilty of a misdemeanor, and upon conviction, shall be punished by a
fine of not less than ten dollars nor more than twenty-five dollars.
8. Any person violating any of the provisions of section four of
this act, shall be deemed guilty of a misdemeanor, and upon conviction
shall be punished by a fine of not less than one hundred dollars nor
more than two hundred and fifty dollars, and confinement in jail not
less than thirty days nor more than six months; provided, however,
that the court or justice trying the case, may remit the jail sentence
upon prompt payment of the fine and. costs.
9. The same fees and rewards shall be paid to officers and in-
formers in cases of violations and convictions under the several sec-
tions of this act, as are provided for in section thirty-three hundred
and forty-three of the Code of Virginia.
10. All acts and parts of acts in conflict with the provisions of
this act, are hereby repealed.
11. An emergency existing, this act shall be in force from its
passage.
