Chap. 422.—An ACT to prohibit the hunting, killing, chasing, snaring, or trap-
ping, tracking in the snow, or chasing with dogs, any elk in the counties of
Bland, Craig, Giles, Montgomery or Pulaski; limiting the number to be
killed during the open season, naming the open season, providing for non-
resident license and the penalties for violation thereof. [H B 382]

1. Be it enacted by the general assembly of Virginia, That it
shall be unlawful, for any person, at any time, to hunt for, shoot at,
take, kill, or wound, or attempt to take, kill or wound, or to track in
the snow, ‘snare or trap, or chase with dogs, any wild elk in the counties
of Bland, Craig, Giles, Montgomery or Pulaski, except as hereinafter
provided.
2. That bucks, with horns plainly visible above the hair, may be
killed between December first and December third, both days in-
clusive, of each season, in the following manner: With rifles only,
and no smaller bore may be used than a twenty-five-twenty (25-20),
and nothing in this section shall be construed to allow hunting or
tracking them in the snow or the running with dogs during the open
season.
3. That only one elk may be killed during an open season by any
one person.
4. The possession of elk meat, skin, or other parts of an elk out of
season, shall be taken as prima facie evidence of guilt under this act.
5. It shall be unlawful for any person to hunt or kill elk at any
time, on any lands used as State or federal game sanctuaries.
6. Any nonresident of this State desiring to hunt elk in any of the
counties mentioned in this act, must, before beginning to hunt therein,
secure from the clerk of the county in which he wishes to hunt, a
certificate permitting him to hunt elk in the county. This certificate
is in addition to the regular State nonresident hunters license, and the
fee charged for such certificate shall be ten dollars.
7. Any person violating any of the provisions of this act, shall
be guilty of a misdemeanor, and upon conviction, shall be punished
by a fine of not less than one hundred dollars, nor more than two
hundred and fifty dollars, and imprisoned in the county jail for not
less than sixty days nor more than six months; provided, however,
that the court or justice trying the case may remit the jail sentence
upon prompt payment of the fine and costs.
The same fees and rewards shall be paid to officers and in-
formers, in case of violations and convictions under the several sec-
tions of this act, as are provided for in section thirty-three hundred
and forty-three of the Code of Virginia.
9. All acts and parts of acts inconsistent or in conflict with this
act are hereby repealed.
