Chap. 42.—An ACT for the establishment of game sanctuaries in this State.

Approved February 26, 1926. :
1. Be it enacted by the general assembly of Virginia, That an
act for the establishment of State game sanctuaries approved Feb-
ruray twenty-fifth, nineteen hundred and twenty-two, be amended
and re-enacted to read as follows:
2. That it shall be lawful for any landowner or landowners to
enter into an agreement with the commissioner of the department of
game and inland fisheries to permit his or their lands to be used as
a State game sanctuary for a period of not less than three years and
that on any land so assigned it shall be unlawful for the owner or any
person to kill, capture or disturb in any manner any wild animal or
its young or any wild bird or its eggs, nests or young without first
obtaining a permit from the commissioner of the department of game
and inland fisheries to do so.
3. The said commissioner may in his discretion give permits to
capture, to kill or destroy any species of wild animal or wild bird on
said State game sanctuaries under such rules and regulations as he
may prescribe; provided, however, that any such animals or birds
taken by the permittee shall not be sold or disposed of otherwise than
provided for by law.
4. Alllands tendered the State as aforesaid, shall be conspicuously
posted as State game sanctuaries, and any person by trespassing or
hunting on same or permitting his dogs to do so, or violating any pro-
visions of this act shall be deemed to have committed a misdemeanor
and upon conviction shall be punished by a fine of not less than
twenty-five dollars nor more than one hundred dollars, or committed
to jail for not more than thirty days, or ‘both, in the discretion of the
justice or jury trying the case.
