and to repeal an act entitled an act providing for the election of the members
of the State Corporation Commission by the qualified voters of the State
and providing for their terms and commission, approved February 16, 1918.

_1. Beit enacted by the general assembly of Virginia, That section
thirty-six hundred and ninety-four of the Code of Virginia, be amended
and re-enacted so as to read as follows:
Section 3694. Appointment of members of State corporation
Commission; terms; commission.—The governor shall, within fifteen
days before the first day of February, nineteen hundred and twenty-
eight, and within fifteen days before the first day of February in each
alternate year thereafter, appoint, subject to the confirmation of the
general assembly, in joint session, a citizen of this State, possessing
the qualifications prescribed by the Constitution and by law to be a
member of the State corporation commission (which shall be com-
posed of three members), and whose terms of office shall be that pre-
scribed by the Constitution, and shall begin on the first day of Feb-
ruary next succeeding his appointment and confirmation except in
the case of an appointee to fill a vacancy, or where the general assem-
bly fails to confirm an appointee to a full term of office before the date
fixed by law for the commencement of his said term of office; in either
case the term of office of any such appointee shall begin from the date
of his qualification, and shall be for the unexpired portion of the term
of office to which he shall be so appointed and confirmed. The mem-
bers of the commission in office when this section, as amended, takes
effect, shall hold office for the respective terms for which they have
been elected and until their respective successors in office have been
appointed, confirmed, and qualified, unless they shall sooner be re-
moved from office as prescribed by the Constitution or by law. The
governor shall commission each of the members of the commission,
and said commission shall be filed by the members in the office of the
clerk of the commission.
2. An act entitled an act providing for the election of the mem-
bers of the State corporation commission by the qualified voters of
the State and providing for their terms and commissions, approved
February sixteenth, nineteen hundred and eighteen, is hereby re-
pealed.
