Chap. 346.——An ACT to provide for a commission of roads and bridges for
Kempsville magisterial district, in the county of Princess Anne, and to
prescribe its powers and duties. {H B 530}
Approved March 24, 1926.
1. Be it enacted by the general assembly of Virginia, That there
is hereby established for Kempsville magisterial district, in the county
of Princess Anne, a commission of roads and bridges, which commis-
sion shall have the powers and duties hereinafter prescribed.
2. The said commission shall consist of five members to be ap-
pointed quadrennially by the board of supervisors of Princess Anne
county from among the qualified voters of the said district; and any
vacancy occurring on the said commission shall be filled by the said
board for the unexpired term. At the first meeting of the said com-
mission it shall elect one of its number chairman and another secre-
tary, who shall serve for the remainder of the calendar year, and
thereafter such chairman and secretary shall be elected annually.
The commission will meet at the call of the chairman or at such time
and place as may be decided on by a majority of the members and
at least three members must be present at any meeting to constitute
a quorum. The time and place for the first meeting of the said com-
mission shall be fixed by the board of supervisors. For their services
on the said commission the members shall be paid such sums, not to
exceed fifty dollars per annum per member, as may be fixed by the
board of supervisors.
3. The said commission hereby created shall be a body corporate,
and shall be known and designated as the ‘‘commission of roads and
bridges of Kempsville district,’’ and as such shall have the right to
contract and be contracted with, sue and be sued. The members of
the said commission shall qualify before the clerk of the circuit court
in the manner provided by law for qualifications of other magisterial
district officers.
4. The said commission shall have full eharge of the construction
and maintenance of all public roads and bridges in the said district
except such as may now or hereafter be a part of the State highway
system or are under the care, maintenance and control of the State
highway commission; and for this purpose shall have sole authority
to contract for the expenditure of any sum or sums of money available
for road and bridge purposes in the said district. All indebtedness
incurred by the said commission shall be paid by the board of super-
visors by warrants drawn on the Kempsville district road funds upon
receipt of monthly statements from the said commission, such state-
ments to be supported by proper bills or invoices.
5. But the foregoing provisions of this act shall not become
effective unless and until at an election held in the said district within
two years from the date of the passage of this act, a majority of the
qualified voters thereof voting shall approve a bond issue for road and
bridge purposes in said magisterial district.
