Chap. 329.—An ACT to amend and re-enact section 5273 of the Code of Virginia,
in relation to the distribution of personal estate. [fH B 406]

1. Be it enacted by the general assembly of Virginia, That sec-
tion fifty-two hundred and seventy-three of the Code of Virginia, be
amended and re-enacted so as to read as follows:
Section 5273.—Distribution of personal estate-—When any per-
son shall die intestate as to his personal estate or any part thereof
the surplus (subject to the provisions of chapter two hundred anc
seventy-four) after payment of funeral expenses, charge of adminis
tration and debts, shall pass and be distributed to and among the
same persons, and in the same proportions, to whom, and in whict
real estate is directed to descend, except as follows:
First. Of infants.—The personal estate of an infant shall be dis
tributed as if he were an adult.
Second. Of married persons.—If the intestate was married, the
surviving husband or wife shall be entitled to one-third of such sur-
plus, if the intestate left surviving children or their descendants of
the marriage which was dissolved by the death of the intestate, or of
a former marriage, or by legal adoption; but if no such children or
their descendants survive, the surviving husband or wife shall be en-
titled to the whole of such surplus; except, where the intestate was a
married woman and left only illegitimate children or their descend-
ants, it is provided that the surviving husband shall be entitled to
only one-third of such surplus.
