Chap. 202.—An ACT to amend and re-enact sections 2 and 4 of an act entitled
an act to incorporate the town of Lebanon, in Russell county, in force Feb-
ruary 21, 1873, as amended by an act approved March 4, 1890, and as further
amended by oan act approved Pebruary 8, P8os, [TW RB 473]

1. Beat enacted by the general assembly of Virginia, That) sec-
tions two and four of an act entitled an act to incorporate the town
of Lebanon, in Russell county, in force February twenty-first, eighteen
hundred and seventy-three, as amended by an act approved March
fourth, eighteen hundred and ninety, and as further amended by an
act approved February eighth, eighteen hundred and ninety-eight,
be amended and re-enacted so as to read-as follows: |
Section 2. The boundaries of said town shall be as follows: Be-
ginning at a point at Little Cedar creek, where the branch from G. H.
Dickenson’s spring flows into Little Cedar creek; thence running up
and with the said creek to the mouth af a small branch on the north
side of said creek, southwest of the old D. K. Banner residencg; thence
a northern direction with said branch to the bridge and center of the
State highway, at S. A. Fletcher’s mill; thence a northeasterly direc-
tion a straight line to a low gap in the graveyard hill; thence eastwardly
with the top of said ridge, enclosing the graveyard, then leaving the
graveyard at the northeast corner of same and running eastward a
straight line to the public road north of the FE. R. Combs property;
thence, with the said road a southern direction to, the northwest
corner of the V. B. Gilmer property; thence east with the northern
line of said property of V. B. Gilmer; thence continuing said line a
straight line to the. line of G. H. Dickenson’s Pinney land; thence a
southern direction with said line to the State highway; thence with
said State highway an eastern direction to the branch and bridge
across said branch that flows from G. H. Dickenson’s spring; thence
with said branch a southern direction to the creek, at the beginning.
Section 4. The council shall have authority to abate, or cause to
be abated, anything which, in the opinion of the council, shall be a
nuisance; to provide for the annual assessment of the taxable property
and persons of said town; to appoint and publish the place of holding
the town elections; to adopt such rules and regulations as they may
deem necessary; to prevent the running at large on the streets and
alleys of the said corporation of hogs, dogs, horses, cattle and any and
all other animals, and to prevent the cumbering of streets, sidewalks
and alleys in any manner whatever; to provide a revenue for and
appropriate the same for its expenses, and said council shall have
power to provide for keeping the streets and sidewalks in good order
and paving the same; to keep the sidewalks free and clean by. the
owners and occupants thereof, and to provide for other necessary
improvements for which purpose they may levy such tax as they. may
deem necessary, not exceeding ninety cents on the one hundred
dollars, and said council shall have power to levy a poll tax of fifty
cents. Said council shall appoint annually a sergeant, and shall fix
his compensation and provide for the payment of same, and prescribe
his duties and require such bond as they may deem proper; such bond
shall be payable to the said corporation. Said council shall have
power to remove said sergeant at any time they may deem proper and
appoint his successor. |
It shall be the duty of the sergeant to take up and impound in a
pen kept for that purpose any hog, pig, or swine found running at
large upon the streets or alleys within the limits of said corporation,
and when any such hog, pig, or swine shall be so taken up and im-
pounded by the said sergeant he shall immediately advertise same
at three public places for ten days, for sale to the highest bidder for
ready cash, and apply the proceeds first to the payment of the cost.
and the bafance to the owner of such hog; provided, that the owner
of such hog, pig, or swine may redeem them at any time before the
sale by paying the cost incurred by penning them; the sergeant shall
charge twenty cents for penning each hog, pig or swine so penned,
and shall charge five cents per day for feeding each hog, pig, or swine
so penned.
2. All acts or parts of acts inconsistent herewith, are to the
extent of such inconsistency, hereby repealed.
3. An emergency existing, this act shall be in force from its
passage.
