Virginia, in relation to hunting, trapping, fishing and ranging upon the

tion thirty-threq hundred and thirty-eight of the Code of Virginia

ction 33384 If any person shoot, hunt, range, fish, trap or fowl on
or in the lands, waters, millponds, or private ponds of another, without
the written consent of the owner to do so, he shall be deemed guilty
of a trespass and upon conviction thereof shall be fined not less than
five dollars nor more than fifty dollars. The above shall not apply
to bona fide fox hunters hunting with hounds, and deer hunters hunt-
ing with dogs where the chase begins on other lands, nor to uninclosed
mountajn lands west of the Blue Ridge mountains not used for culty

And if any person after being warned not to do so by the owner, or
his agent, shall go upon the property of the said owner, he shall, in =
addition to the liabilities imposed under this section be deemed guilty
of a misdemeanor, and upon conviction thereof, punished by a fine
not exceeding fifty dollars or imprisoned in the county jail not ex-
ceeding sixty days, or both, in the discretion of the justice or jury
trying the case. Provided, further, that no game warden or other
officer having jurisdiction be authorized to arrest or prosecute for
any violation of this section if the owner or his agent objects to such
