Chap. 13.—An ACT to amend the charter of the town of South Boston, in the
county of Halifax, by adding thereto two scctions, ta he numbered 28 ‘and 29.

1. Be it enacted by the general assembly of Virginia, That the
charter of the town of South Boston be amended by adding thereto
two sections, to be numbered twenty-eight and twenty-nine and tc
read as follows:
Section 28. The council shall have authority to restrict or pro-
hibit the erection, construction, maintenance or operation of any pub-
lic gasoline or oil filling station or sales depot in the said town when
three-fourths of the buildings on both sides of the street for a distance
of five hundred feet in either direction from the proposed location of
such filling station or sales depot, are used exclusively for residence
purposes, unless the person proposing to erect or operate such filling
station or sales depot shall first obtain and present to the council the
written consent of two-thirds of the owners of the property abutting
on the street for a distance of five hundred feet in each direction
from the proposed location of such gasoline or oil filling station or
sales depot, and to prescribe penalties for violations of such ordi-
nance or ordinances. Provided, no such action of the council shall
impair any vested right.
Section 29. For the promotion of the health, safety, morals, com-
fort, prosperity and general welfare of the general public the council
may by ordinance divide the area of the town into one or more dis-
tricts of such shape and area as may be deemed best, and in such dis-
trict or districts may establish set back building lines, regulate and
restrict the location of buildings and other structures, their height,
area and bulk, the percentage of lot to be occupied by buildings or
other structures, the size of courts and other open spaces, and the trade,
industry, residence and other specific uses of the premises in such dis-
trict or districts; provided that nothing herein contained shall be con-
strued as intended to authorize the impairment of any vested right.
2. The general welfare of the citizens of the town and their safety
and financial interests requiring the prompt enactment of this amend-
ment, an emergency is declared to exist and this act shall be in force
from its passage.
