Chap. 87.—An ACT to enable the town of Virginia Beach, in Princess Anne county ,
Virginia, to contract with the city of Norfolk for an adequate water supply
authorizing said town and said city to sell water to consumers in the county of
Princess Anne, and authorizing the said town to levy a special tax on real
estate and personal property for a period of ten years for the purpose of raising
funds to pay interest upon the cost of constructing a pipe line from Moore’s
bridge, in Princess Anne county, to the corporate limits of the town of Vir-
ginia Beach. (S B 230],

Whereas, The water supply of the town of Virginia Beach is wholly
inadequate to supply its citizens with water and to protect property in
3aid town from danger of loss by fire; and
Whereas, There is no available water supply near enough to the said’
town of Virginia Beach to be available, by reason of the prohibitive cost
of constructing the necessary plant and transmission line; and
Whereas, The city of Norfolk, by reason of recent development of
and additions to its water supply system, has a large amount of surplus.
water, more than enough for its own use and for supplying the said town
of Virginia Beach therewith; and
Whereas, The city of Norfolk is willing to construct a water main
from an intersection with its main at Moore’s bridge, in Princess Anne
county, to the corporate limits of the said town of Virginia Beach, a
distance of about eleven and one-half miles, and to deliver water at said
point to the distribution system of the said town of Virginia Beach,
upon the condition that the said town of Virginia Beach enter into a
contract with the city of Norfolk, agreeing to purchase water from the
sald city of Norfolk for a period of twenty (20) years, at prices and upon
terms and conditions to be therein agreed upon and set forth, and in-
cluding, inter alia, the obligation of the town of Virginia Beach to pay
to the city of Norfolk the sum of twelve thousand dollars ($12,000.00)
per year, in semi-annual installments of six thousand dollars ($6,000.00)
each, for a period of ten (10) years from and after the completion of the
said main by the city of Norfolk, such payments being an amount equal
to interest at six per centum (6%) per annum on the sum of two hun-
dred thousand dollars ($200,000.00), the estimated cost of the con-
struction of said water main by the city of Norfolk; and
Whereas, In order to enable the town of Virginia Beach to enter
into and perform the said proposed contract with the city of Norfolk,
it is necessary to confer upon the said town of Virginia Beach, and upon
the city of Norfolk, additional powers not now possessed by them;
‘Therefore,
1. Be it enacted by the general assembly of Virginia, That it shall
be lawful for the city of Norfolk and the town of Virginia Beach to
enter into and perform contracts for the sale of water to the town of
Virginia Beach and to consumers in the county of Princess Anne, upon
the terms and conditions set forth and recited in the preamble to this
act and upon such further terms and conditions as may be provided in
such contracts.
2. That the town of Virginia Beach shall have the power and
authority to charge and collect a ready-to-serve charge against owners
of all property connected or to be connected with its water distribution
system, jn addition to the sale price of water delivered through the
meters installed by it.
3. That in order to enable the said town of Virginia Beach to make
the payments to the city of Norfolk required by the said contract, the
council of the town of Virginia Beach is hereby granted the right and
power, in addition to the powers already possessed by it, to levy an-
nually, for a period of ten years, a tax in such amount as may be neces-
sary for such purpose on all real estate and personal property in said
town of Virginia Beach; provided, that the amount of the tax so to be
levied annually hereunder shall not be in excess of the amount necessary
to pay to the city of Norfolk annually the sum of twelve thousand dol-
lars ($12,000.00), or six per centum (6%) interest upon the actual cost
of the installation of the said water main.
4. An emergency existing, by reason of a present water famine at
Virginia Beach, this act shall be in force from its passage.
