Chap. 71.—An ACT sathorting te town of Colonial Beach in Westmoreland
county to convey to Frank Blackistone upon certain conditions a certain
street within its corporate limits. (H B 114}
Approved February 29, 1924.
Whereas, by deed dated February sixteenth, nineteen hundred and
three, the town of Colonial Beach, in Westmoreland county, conveyed
to E. S. Randall a certain street within its corporate limits described as
follows:
“Beginning at the intersection of Taggart street extended where it
intersects Westmoreland avenue, thence with the same course that
Westmoreland avenue now has—fifty feet wide—to a point one hundred
and fifty feet west of the Potomac river, with a right of way from its
terminus to the Potomac river;” and
Whereas, in exchange for the said street E. S. Randall and wife, by
deed dated February sixteenth, nineteen hundred and three, conveyed
to the town of Colonial Beach the following property within its cor-
porate limits to be used as and for a street, and more fully described as
ollows:
“Beginning at a point being the southeast corner of Taggart street
extended where Franklin avenue intersects it, thence in a northerly direc-
tion forty feet, thence at right angles in an easterly direction with the
same course that Franklin avenue now has, to a point one hundred and
fifty feet west of the Potomac river, thence south forty feet, thence in a
westerly direction to the place of beginning, with a right of way over the
land forty feet by one hundred and fifty feet that lies east of Franklin
avenue just conveyed to the Potomac river;” and,
Whereas, the above property conveyed by the town of Colonial
Beach to E. S. Randall has passed to and is now owned by Frank D.
Blackistone; and,
Whereas, it is desired that the town of Colonial Beach shall now
convey to Frank D. Blackistone the said property above described,
which was conveyed to it by E. S. Randall and Frank D. Blackistone,
shall now convey to the town of Colonial Beach the above described
property which was conveyed by the said town to E. S. Randall; and,
Whereas, on the thirteenth day of December, nineteen hundred and
twenty-three, the town council of Colonial Beach passed a resolution
approving the proposed exchange of property with Frank D. Blackistone,
and requesting the generat assembly of Virginia to authorize the neces-
sary conveyances; now, therefore,
1. Beit enacted by the general assembly of Virginia, That the town
of Colonial Beach be, and is hereby, authorized and empowered to con-
vey to Frank D. Blackistone by proper deed the said street formerly con-
veyed to it by E. S. Randall and more fully described as follows:
“Beginning at a point being the southeast corner of Taggart street
extended, where Franklin avenue intersects it, thence in a northerly
direction ‘forty feet, thence at right angles in an easterly direction with
the same course that Franklin avenue now has, to a point one hundred
and fifty feet west of the Potomac river, thence south forty feet, thence
in a westerly direction to the place of beginning, with a right of way
over the land forty feet by one hundred and fifty feet, that lies east of
Franklin avenue, just conveyed to the Potomac river.’
Provided, however, that the said conveyance shall not be made unless
and until the said F rank D. Blackistone shall have conveyed to the town
of Colonial Beach by proper deed the said strect formerly conveyed by
the said town to E. S. Randall and more fully described as follows:
“Beginning at the intersection of Taggart street extended where it
intersects Westmoreland avenue, thence with the same course that
Westmoreland avenue now has—fifty feet wide—to a point one hun-
dred and fifty feet west of the Potomac river, with a right of way from
its terminus to the Potomac river.”’
2. Anemergency existing, this act shall be in force from its passage.
