Chap. 56.—An ACT to release unto G. B. Morehead all the right, title and interest
of the public in certain real estate in the town of Wytheville. [S B 280]

Whereas, The consideration for the conveyance to the county of
Wythe of certain real estate by the heirs and devisees of W. H. Spiller,
was an agreement-by which the said county relinquished all of its right,
title and claim to the ground formerly occupied by the jail and inclosure
around the same extending from the back of the then court house build-
ing to Monroe street, to be kept and used as open public ground for the
benefit of the public, as more fully appears from the orders of the court
dated December twelve, eighteen hundred and sixty-five, et sequentes;
and
Whereas, the relinquishment of its right by the county in the ground
formerly occupied by the jail inclosure, was primarily for the benefit of
the heirs and devisees of W. H. Spiller; and
Whereas, the court house was afterwards moved to another location,
and the lot whereon the then court house stood, sold at auction by the
county of Wythe; and
Whereas, by agreement with the heirs and devisees of W. H. Spiller,
the owners of the court house lot were authorized to inclose and build
upon the same for a distance of one hundred and twenty feet from the
northwest line of Main street; and
Whereas, by deed dated November third, nineteen hundred and
eleven, the owners of the court house lot conveyed to the town of Wythe-
ville fifteen feet along the east side of said lot for the purpose of widening
Tazewell street in said town, and by the same deed the town of Wythe-
ville released to the owners of said lot all of its right, title and interest
to so much of said lot as lies southeast of a line one hundred and twenty
feet northwest of and parallel to the northwest line of Main street in
said town; and,
Whereas, it is to the public interest that Tazewell street be widened
fifteen feet; and
Whereas, There is no public necessity requiring the keeping open of
so much of the old court house lot as lies southeast of the line above
mentioned; and,
Whereas, G. B. Morehead is the present owner of the said old court
house lot; now therefore,
1. Be it enacted by the general assembly of Virginia, That G. B.
Morehead and his successors in title are hereby authorized and em-
powered to inclose, build upon and otherwise make use of so much of
the old court house lot in the town of Wytheville as lies southeast of a
line one hundred and twenty feet northwest of and parallel to the north-
west line of Main street in the town of Wytheville and is bounded on the
east by the west line of Tazewell street, and on the west by the east line
of a tert fodt alley, ranping between the Spiller property and the old
court house-lot, and that alk right, title and interest of the public in
and to.the same be and they are hereby extinguished.
The.sale: of said:oid comrt house lot being delayed by a doubt as to
the interest of the .public therejn,.an emergency is hereby declared to
exist and this act shall be in force from its passage.
