Chap. 436.—An ACT to validate substitutions of trustees under deeds recorded in
Virginia heretofore made in the courts of Virginia without sufficient notice or
without any notice to some one or more of the persons interested in the trusts
of such deeds, and to validate acts done by such substituted trustees. [H B 18]

Whereas, trustees have been substituted by proceedings in tae
courts of Virginia in place of original trustees under deeds recorded in
Virginia, without sufficient notice or without any notice to some one
or more of the persons interested in the execution of the trusts of such
deeds, and such substituted trustees have performed various acts on
the credit of their substitutions, which substitutions and acts have been
relied upon as valid by many persons affected thereby; and
Whereas, the invalidity of such substitutions and acts would avoid
or unsettle numerous titles to real and personal property acquired for
value and in good faith and would result in great hardship to the claim-
ants thereof; therefore,
1. Be it enacted by the general assembly of Virginia, That all such
substitutions and acts heretofore made and done shall be held, and the
same are hereby declared valid and effective in all respects if otherwise
valid according to law then in force; provided, however, that this act
shall not become effective as to any person who, but for the passage
thereof, may have the right to impeach any such substitution or any
act done by such substituted trustees until after the lapse of twelve
months from the date of the passage of this act.
2. An emergency existing, this act shall be in force from its passage.
