Chap. 398.—An ACT to protect game in the county of Shenandoah by regulating
hunting therein by non-residents of the State of Virginia, and to provide
penalties for violation thereof. [S B 409]

Whereas, it appearing to the general assembly of Virginia that a
large number of non-residents of the State of Virginia hunt in the
county of Shenandoah, and that by reason thereof great quantities of
game in said county are killed by such non-residents and carried out
of this State, and that by reason of such hunting tre game of Shenan-
doah ccunty is being threatened with destruction, and that to protect
the game of said county, legislation regulating and restricting the
hunting of non-residents in the county of Shenandoah is necessary;
now, therefore, ,
1. Be it enacted by the general assembly of Virginia, That in
addition to all the provisions and requirements of the general laws of
the State of Virginia as to hunting by non-residents, it shall be un-
lawful for any non-resident of the State of Virginia to hunt, kill, or
capture any game in the county of Shenandoah on lands other than
land actually owned by him, except as provided in this act.
Every non-resident of the State of Virginia shall, in addition to
taking out the license now required by law, secure from the clerkYof
Shenandoah county, a certificate permitting such non-resident to hunt
in the county of Shenandoah.
Every non-resident desiring to hunt in the county of Shenandoah,
after securing the State license as now provided by law, shall, in person,
apply to the clerk of Shenandoah county for permission to hunt in
Shenandoah county, and shall make application in writing, as herein-
after provided in this act, for permission to hunt in said county. The
application shall be signed and sworn to before the clerk. The said
application shall contain the following information and be substantially
in form as follows:

The number of days he desires to hunt in Shenandoah county............
‘The calendar dates of the days on which he expects to hunt............
The name and address of the person or place of entertainment,
with whom, or where he will stay while hunting in said county. . The
clerk shall receive a fee of fifty cents for administering the oath to each
application.
After making the application aforesaid, each non-resident of the
State of Virginia shall pay to the said clerk the following amounts for
the privilege of hunting in the county of Shenandoah:
For the privilege of hunting three days, ten dollars.
For the privilege of hunting four days, twenty dollars.
For the privilege of hunting five days, thirty dollars.
For the privilege of hunting six days, fifty dollars.
For the privilege of hunting more than six days, seventy-five dollars.
After receiving the application, and upon receipt of payment of the
amounts hereinbefore mentioned, the clerk shall issue to each non-
resident a certificate permitting and authorizing the said non-resident
to hunt in the county of Shenandoah, which said certificate shall be in
the following form: State of Virginia,

resident of the State of Virginia, has made application in writing and
paid the amount required by law for the privilege of hunting in the
county of Shenandoah, and is entitled to hunt in said county beginning
on the... day of... ee. , 19........ , and is entitled to hunt
(0) ee days as follows: (Here to be inserted the days upon
which said non-resident may hunt, or the period during which he may
hunt, setting forth the first and last day.)
Given under my hand this........................ day of... , 19.00...
After obtaining the certificate aforesaid, any non-resident shall be
entitled to hunt in the county of Shenandoah on the days, or for the
period mentioned in the said certificate, and under all restrictions and
regulations applicable to hunting in the county of Shenandoah.
Should any non-resident by reason of sickness, inclement weather,
or for other good reason be unable to hunt on any day or days set forth
in said certificate, he may, upon application in person to the said clerk,
be granted permission to hunt other days, not exceeding the number
of days for which he has paid the fee herein required, and not exceeding
the number of days he did not hunt. The clerk shall make written
endorsement upon the said certificate, setting forth distinctly what
days, other than those named on the face of the certificate, the said
non-resident is entitled to hunt. The clerk shall swear each non-
resident applying to him for a change of dates as herein provided, and
shall refuse to grant permission to hunt on other dates, unless he is
satisfied that such non-resident has been prevented from hunting, and
the burden of establishing the right to hunt on any other day or days
shall be upon the non-resident, and decision of the clerk shall be final.
The clerk shall file all applications herein provided for by the year,
and shall keep the same on file for the period of five years.
Every non-resident of this State who has been granted permission
to hunt in the county of Shenandoah as herein provided, shall, before
departing from the said county, personally appear before the clerk of
said county, or the game warden of said county, or the sheriff of said
county, and make affidavit in writing that he has not violated any of
the game laws of the State of Virginia, applicable to the county of
Shenandoah, or any regulation of the board of supervisors of said
county, in regard to hunting therein, and that he has not, directly or
indirectly, sent out of said county any game whatsoever, and that he
will not, directly or indirectly, take out of said county, or have sent to
him after he has gone out of said county more than fifteen quail, two
ruffed grouse, two ring-necked pheasants, one wild turkey, ten rabbits,
and ten squirrels in any one calendar year. The officer before whom
each non-resident appears and makes the foregoing affidavit is hereby
authorized to administer the oath to the same and shall be paid a fee of
fifty cents. Any such officer before whom any non-resident appears
and makes the affidavit aforesaid is hereby authorized, if he has good
reason to believe that said non-resident is attempting to carry with
him out of the State more game than is herein provided, to search the
baggage, automobile, or conveyance of the said non-resident without
a search warrant.
It shall be unlawful for any non-resident to take or to cause to be
taken out of the county of Shenandoah in any year more game than as
follows: fifteen quail, two ruffed grouse, two ring-necked pheasants,
one wild turkey, ten rabbits, and ten squirrels. Provided further, he
may take such quantities of any other game not herein mentioned as
may be permitted under the laws of the State.
The moneys received by the clerk from non-residents under this act
shall be a special game fund for the county of Shenandoah. The same
shall be held and deposited by the clerk as a special game fund "of
Shenandoah county, and shall be under control of the board of supervis-
ors of said county and expended upon the order of said board. The
board of supervisors may use the said fund to pay the county game
warden or his deputies compensation in addition to that now allowed
by law, and may also use the said fund as the said board deems advis-
able for the protection of game in Shenandoah county.
Any non-resident who shall knowingly make a false statement in
his application to hunt in the county of Shenandoah, or in the affidavit
herein provided to be made by him before departing from said county,
shall be guilty of a misdemeanor and shall be punished by a fine of not
less than one hundred dollars nor more than five hundred dollars, and
by being confined in jail not less than ten nor more than sixty days.
Any non-resident of this State who shall hunt in the county of Shenan-
doah without complying with the provisions of this act shall be guilty
of a misdemeanor and shall be punished by a fine of not less than one
hundred dollars nor more than five hundred dollars, and by being con-
fined in jail not less than thirty days nor more than six months.
Any person violating any provision of this act for which no specific
punishment is provided shall be guilty of a misdemeanor and shall be
punished by a fine of not less than twenty-five dollars nor more than
one hundred dollars and by a jail sentence of not less than five nor
more than sixty days.
It shall be the duty of the clerk of Shenandoah county upon issuing
the certificate herein provided to a non-resident to advise and inform
such non-resident of this act.
