‘Chap. 308.—An ACT to provide for the recordation by clerks of courts of honor-
able discharges of Virginians who served in the military or naval forces of
the United States or its associates during the late World War; to direct the
Virginia war history commission to prepare and furnish to such clerks books
suitable for such recordations, and to appropriate money to carry out the
provisions of this act. [H B 386]

1. Be it enacted by the general assembly of Virginia, That whenever
the honorable discharge of any person who served in the military or naval
forces of the United States or its associates during the late World War,
and who at the time of entering such service was a resident of Virginia,
shall be delivered to the clerk of any court in this State, in the office of
whom deeds are admitted to record, the said clerk shall record the same
in the book hereinafter provided for.
2. The clerk of the circuit court of each county and the clerk of
each city court in the office of whom deeds may be admitted to record
shall procure a loose leaf binder suitable for permanent record purposes
of such standard form as shall be prescribed by the Virginia war history
commission, and sufficient loose leaves printed in such blank form as
may be prescribed by said commission, which shall be known as the
“World War Memorial Record,’”’ and which shall be a public record
book of such clerk’s office. This record book shall be provided within
twelve months from the date this act takes effect, and shall be paid for
by the boards of supervisors of said counties and the councils of said
cities as other, clerk’s office books are provided to be paid for, and it
shall be the duty of such clerk to record therein the honorable dis-
charges as aforesaid.
Provided, however, that whenever any such clerk shall have recorded
such honorable discharges in any other book prior to receipt of the special
books to be furnished under this act, such prior recordations are hereby
validated and approved; and such recordations and certified copies
thereof heretofore or hereafter furnished shall have the same force and
effect as those provided by this act and whenever the war history com-
mission shall approve the form of the record book already in use, it shall
re optional with such clerk to continue the use of such present record
ook.
3. For recording each such discharge the clérk shall collect the sum
of thirty-five cents, twenty-five cents of which shall be retained by him
and ten cents of which shall be paid by him into the county or city
treasury. And for furnishing each certified copy of any such discharge
the said clerk shall be entitled to a fee of fifty cents. Such fees shall be
payable by the person desiring the recordation or the certified copy.
No tax shall be charged on such recordations, nor shall any tax be
charged for the seal annexed to such certified copies. Copies of such
honorable discharges certified by the clerk shall be received as evidence
of the facts therein stated.
