Chap. 253.—An ACT to amend and re-enact section 3119 of the Code of 1919, re
tive to costs to be collected by civil justices. [S B 91]

1. Be it enacted by the general assembly of Virginia, That section
thirty-one hundred and nineteen of the Code of Virginia, of nineteen
hundred and nineteen, be amended and re-enacted so as to read as fol-
ows:
Section 3119. At or before the time of hearing had before such civil
justice on any claim the plaintiff (in such claim) shall pay to the said
civil justice a trial fee of fifty cents for each hundred dollars of value, or
fraction thereof, claimed in such warrant. The trial fee shall be taxed
as a part of the costs. Said civil justice shall monthly pay into the
treasury of his city all trial fees collected by him.
In cities containing one hundred and seventy thousand inhabitants
or more, by the latest United States census, a fee of twenty-five cents,
in addition to the trial fee above provided for, shall be paid upon any
continuance (except the first) of any warrant or other matter pending
before said civil justice, by the party asking therefor; provided, however,
that such continuance fee shall not be taxed as part of the costs. Said
civil justice shall monthly pay into the treasury of his city all fees col-
lected by him.
