Chap. 227.—An ACT to ratify, approve and confirm certain conveyances of the
Berryville Turnpike Company; and to provide for the distribution of the assets
of the said company among its stockholders. (S B 179]
Approved March 14, 1924.
1. Be it enacted by the general assembly of Virginia, That the
transfer and conveyance from the Berryville Turnpike Company of the
property known as gate number two, situated west of the town of
Berryville, Virginia, to Joseph F. Moore by deed dated October twenty-
seventh, nineteen hundred and twenty-three, and the transfer and con-
veyance of the property known as gate number three, situated on the
Berryville turnpike east of the town of Berryville, Virginia, to W. A.
Bradford by deed dated October twenty-seventh, nineteen hundred and
twenty-three, and the proy erty known as gate number one situated east
of the city of Winchester to Joseph H. Patton by deed dated October
twenty-seventh, ninetee: hundred and twenty-three, all of which deeds
were made pursuant tv a resolution of the hoard of directors of the
Berryville Turnpike Company as authorized by the stockholders, be,
and the same are here':y, ratified, validated, approved and confirmed,
and the title to the said property shall be thereby vested in the respective
grantees in said deeds, rubject to any deeds of trust that may have been
given thereon.
The transfer and conveyance from the Berryville Turnpike Company
to the Commonwealth of Virginia, of that certain turnpike road extend-
ng from Winchester, Virginia, in the county of Frederick, to the west
bank of the Shenandoah river at Castleman’s ferry in Clarke county,
and known as the Berryville turnpike, by deed dated January fifteenth,
nineteen hundred and twenty-four, shall, subject to all restrictions,
limitations and conditions therein contained, be, and the same is hereby,
ratified, validated, approved and confirmed and the title to the said
turnpike road shall be thereby vested in the Commonwealth of Virginia.
The Commonwealth of Virginia being the owner of two-fifths of the
stock of the Berryville Turnpike Company, two-fifths of the funds now
on deposit to the credit of the said company, together with any other
funds that may be derived from the sale of property or other assets of
said company shall be paid to the State highway department and shall
be expended in the construction, repair and maintenance of the roads
and highways in the counties of Frederick and Clarke that constitute
a part of the State highway system.
If any of the stockholders, or their legal representatives, cannot be
found by January first, nineteen hundred and twenty-five, the treasurer
of the Berryville Turnpike Company shall give notice by publication for
thirty days in some newspaper published in the city of Winchester,
Virginia, giving a list of the stockholders who cannot be located. If on
July first, nineteen hundred and twenty-five, any of the stockholders,
or their legal representatives cannot be found, then the assets which
remain after payment to the Commonwealth of its distributive two-
ae share, shall be distributed pro rata among the then known stock-
holders.
