CHAP. 159.—An ACT to amend and re-enact an act entitled an act to provide for
the appointment of road superintendents in the county of Elizabeth City; to
define their terms of office and their duties, which became a law January 14
1904, without governor’s signature. fH B 302}

1. Be it enacted by the general assembly of Virginia, That it shall
be optional with the board of supervisors of Elizabeth City county as to
whether the said county shall have one superintendent of roads for said
county, as provided for in chapter eighty-five of the Code of Virginia of
nineteen hundred and nineteen, or one road superintendent for each
magisterial district in the said county.
2. The said board of supervisors shall, at its next regular meeting
after this act goes into effect, and at its regular meeting in January
every two years thereafter, pass upon said matter by a recorded vote.
3. If the vote shall be in favor of having a road superintendent for
each of the magisterial districts of the said county then the said board
shall, at the same meeting, proceed to appoint one road superintendent
for each magisterial district in the said county, who shall be a voter and
resident of such district. The term of office of each road superintendent
shall begin on the first day of February succeeding his appointment, and
shall continue for two years thereafter, unless removed by said board,
except that, if an appointment be made under the terms of this act
during the year nineteen hundred and twenty-four, the term of office of
the road superintendent elected at such meeting shall begin on the first
of the month next succeeding their election or appointment, and they
shall continue in office until the first day of February, nineteen hundred
and twenty-six, unless sooner removed by said board. The board of
supervisors of said county shall prescribe the compensation of each road
superintendent at the time of his appointment. Each road super-
intendent in his respective magisterial district shall have the same
powers, perform the same duties, and be subject to the same liabilities
as are provided by general law for the government and control of county
road superintendents; and he shall qualify for office in the manner pre-
scribed by general law for the qualification of road superintendents for
counties.
4. If the vote shall be in favor of having one road superintendent
for said county then the appointment shall be made by the board of
supervisors of said county as provided for in chapter eighty-five of the
Code of Virginia, nineteen hundred and nineteen, except that any ap-
pointment made under this act in the year nineteen hundred and twenty-
four shall be made at the same time and for the same period as pro-
vided for in paragraph three (3) hereof for the appointment of road
superintendents for the several districts of the said county.
5. All acts and parts of acts, in so far as they conflict herewith,
are to that extent repealed.
6. An emergency existing, this act shall be in force from its passage.
