Chap. 136.—An ACT to authorize the town council of the town of Stuart to issue
$5,000.00 of bonds for the construction and permanent improvement of certain:
streets in said town. (H B 286}
Approved March 14, 1924.
1. Be it enacted by the general assembly of Virginia, That the
ordinance adopted by the council of the town of Stuart on the................
day of. 2... , hineteen hundred and twenty-four, authorizing
the issuance of five thousand dollars of street construction and improve-
ment bonds, for the purpose of constructing and permanently improv-
ing certain streets in the said town therein set forth, be and the same is
in all respects, validated and confirmed.
2. The town of Stuart, Virginia, is hereby authorized to issue five
thousand dollars of street construction and improvements bonds author-
ized by said ordinance, to-wit: Five bonds, numbered from one to five,
inclusive, of the denomination of one thousand dollars each, dated
February first, nineteen hundred and twenty-four, and payable Febru-
ary first, nineteen hundred and thirty-four, with interest at the rate of
six per centum per annum, payable semi-annually, provided, however,
that no bonds shall be issued under this act unless and until at a special
election to be held in said town on such date as may be fixed by the
council a majority of the qualified voters living within the corporate
limits of said town and voting in the said election shall vote in favor of
such bonds. And it is hereby made the duty of the regular election
officers to prepare the ballots and otherwise provide for the submission
of the said question to the voters at the said election; on each ballot
shall be printed in separate lines the following:
For bond issue
Against bond issue
Voters desiring to vote in favor of the issuance of said bonds shall strike
out the words ‘‘Against bond issue,” and voters desiring to vote against
bond issue shall strike out the words “‘For bond issue.” Voters striking
out or erasing the words ‘‘For” or “Against” shall be deemed to have
stricken out or erased the entire line. But it is moreover expressly pro-
vided that the said council may, if it so desires, provide for the submis-
sion of the said question to the voters aforesaid at the regular election
to be held in the said town on the second Tuesday in June, nineteen
hundred and twenty-four, instead of having a special election as afore-
said.
3. The council of the town of Stuart is hereby authorized to amend
said ordinance in any respect, except to increase the amount of bonds
to be issued, by further ordinance or ordinances, and to change the
numbers, denominations, date, maturity or interest rate of said bonds
or to make any other change in respect thereto which shall be con-
sistent with the provisions of the charter of the said town and the laws
of the State affecting the authorization and issuance of bonds.
4. An emergency exists in said town necessitating the issuance of
said bonds, an emergency is declared to exist‘and this act shall be in
force and effect from the date of its passage.
