Chap. 112.—An ACT to authorize the boards of supervisors of counties
having less than 15,000 population and adjoining one or more cities of
the first class to enact special and local legislation in their respective
counties, for the protection of the public roads, ways and bridges,
and the lives and property of persons using such roads, providing a
penalty for the violation of such legislation, and providing compensa-
tion for special services rendered by supervisors. [H B 7]

1. Be it enacted by the general assembly of Virginia, That
the boards of supervisors of all counties having less than 15,000
population and adjoining one or more cities of the first class
shall have the power to enact such special and local legislation
in their respective counties, not in conflict with the Constitution
or the general laws of the Commonwealth, or, so far as the
roads in the State highway system are concerned, with any
regulation promulgated by the State highway commission as
they may deem expedient to protect the public roads, ways and
bridges of such counties, from encroachment or obstruction, or
from any improper or exceptionally injurious use thereof, and
to regulate the traffic on such roads for the protection of the
lives and property of persons using the same: provided that
Said boards may designate the road or roads to which such
legislation shall apply. This power shall extend to and may
be exercised over turnpike roads, the control of which has been
given said boards of supervisors, whether tolls be taken thereon
or not. But no such boards of supervisors shall have power to
limit the hauling of farm products at any time.
2. Each member of the said boards of supervisors may be
allowed as compensation for his services in the supervision of
the opening and repair of the public roads, or the construction
and repair of bridges of such counties, not exceeding five dol-
lars per diem for the time he shall be necessarily so employed,
but no supervisor shall receive for such services compensation
to exceed one hundred and fifty dollars per annum in addition
to the amount allowed by law for other services.
38. Any violation of any such enactments shall be deemed
an offense against the county, whose boards of supervisors
shall have enacted such legislation, and shall be punished by
a fine of not less than two dollars and fifty cents, nor more
than one hundred dollars, or by imprisonment in jail not more
than thirty days, or by both, in the discretion of the justice,
court or jury trying the case, which said fine shall be payable
to such county.
