CHAP. 105.—An ACT.to amend and re-enact sections one (i), eight (8)
and nine (9) of an act entitled an act to incorporate the town of
Dublin, in Pulaski county, Virginia, approved March 14, 1906.

1. Be it enacted by the general assembly of Virginia, That
ections one, eight, and nine of an act entitled an act to incor-
orate the town of Dublin, in Pulaski county, Virginia, approved
{arch fourteenth, nineteen hundred and six, be and they are
ereby amended and re-enacted so as to read as follows:
Section 1. Beginning at the cattle guard on the Norfolk
nd Western Railway, in front of the property of W. 8S. Morton;
hence south at right angles with said railway to a point in the
ine of said Morton property; thence in an easterly course, cross-
ng the Newbern road, to the southwest corner of the residence
f J. W. Walker at a point in the line of the land of F. H. Jordan;
hence along said Jordan’s line in an easterly course to the
outhwest corner of the land of Mistress Margaret W. Darst, on
he north side of the public road; thence along the north side
f said road, passing the pumping station of said town, to a
int opposite the gate on the road leading southward towards
he lands of E. D. Withrow; thence in a northerly course to a
yoint on the south side of the Norfolk and Western Railway’s
ight of way, one thousand and six feet (1006) east of the cattle
ruards, located just east of the depot; thence in a northerly
ourse, across railroad, at right angles with said railroad,
hrough the property of John 8S. Cecil and W. D. Smith, to a
yoint in the line of the lands of Trinkle Brothers, fifteen hundred
ind ten feet: thence with the line of said Trinkle Brothers’ land,
outh fifty-seven degrees, west eighteen hundred and fifty feet,
0 a point on the west side of Institute street (formerly Giles-
-ulaski turnpike) ; thence along the west side of said street to
1 point which marks the northeast corner of the public school
roperty; thence westward with the line of Francis Bell to the
1orthwest corner of said school property; thence with the line of
[Trinkle Brothers land to the southwest corner of the school
yroperty ; thence eastward, following Trinkle Brothers line one
1undred feet to a point; thence south twenty-two degrees three
ninutes east thirteen hundred and fifteen feet to a point; thence
outh thirty-five degrees east four hundred and twenty feet to a
0int in the south side of McAdam road, known as the Lee high-
way ; thence along south side of said highway to a point opposite
he cattle guard at the starting point, at right angles with said
‘ailway; thence to the cattle guards; the place of the beginning,
ye, and is hereby, made a town corporate by the name of the
own of Dublin, of the county of Pulaski, and by that name shall
1ave and exercise all the rights, powers, and privileges con-
ferred, and be subject to the duties, liabilities, and restrictions
mposed by the law for the government of towns of less than five
thousand inhabitants. And that the mayor and councilmen shal
have and exercise all the powers conferred upon them by the
laws of this State, and the powers hereinafter granted of saic
officers, and shall remain in office until their successors shal.
have been elected and have qualified according to law; a ma-
jority of said councilmen shall form a quorum for the trans-
action of business.
Section 8. The council shall annually order a levy upor
all persons, male and female, within said town over twenty-one
years of age, and all real estate within said town, not exempt
by law from State taxation, and on all personal property anc
other subjects as may at the time be subject to taxation, by this
charter or the laws of this State; provided that no tax upon rea!
or personal propery, in said town, except taxes for the purpose
of paying the principal or interest of bonds of the town, now au-
thorized or that may hereafter be authorized, or for the purpose
of providing a sinking fund for the payment of the bonds of the
town, shall exceed one dollar and fifty cents ($1.50) upon the
one hundred dollars assessed value thereof; provided however.
the rate of taxation on any subject or for any purpose shall not
exceed that prescribed by general law. It shall be the duty of
the said town council to levy annually on all taxable property
in said town a tax sufficient to pay the interest on all bonds for
said town as such interest falls due, and also sufficient to pay the
principal of said bonds, as such principal falls due, or to provide
sufficient sinking fund for the payment of said principal at
maturity.
Section 9. The town council shall have, subject to the pro-
visions of this act, the control and management of the fiscal and
municipal affairs of the town and of property, real and per-
sonal, belonging to said town, and make such ordinances, orders
and by-laws relating to the same as they shall deem proper and
necessary; they shall likewise have power to make such ordi-
nances, orders, by-laws, and regulations not inconsistent nor ir
conflict with the laws of this State or the United States, as they
shall deem necessary to carry out the powers which are hereby
vested in them; they may establish, enlarge, and operate ¢
system of water works within or without the limits of said
town; contract or agree with the owners of any land for the
use and purchase thereof, or to have the same condemned ac-
cording to law, within or without the town, for the location.

2. An emergency existing, this act shall take effect from its
passage.
