Chap. 101.—An ACT to provide for the condemnation of land for school
purposes in Arlington county, Virginia. fH B 115]

1. Be it enacted by the general assembly of Virginia, That
if in the judgment of the county school board of Arlington
county the public interests demand that a school house be located
on a particular spot within the said county, or when a school
house is already located in said county upon land purchased or
acquired for such purposes and more land is needed for school
purposes, and no equitable arrangements for its purchase prove
to be practicable, the county school board shall be authorized,
and it shall be its duty, to cause the desired parcel of land to be
surveyed by the county or other competent surveyor, and a plat
of the same to be filed, together with a general statement of the
case, with the clerk of the circuit court; and thereupon, on ap-
plication of the county school board, the same proceedings shall
be had as are prescribed by the laws relating to the exercise of
the right of eminent domain, but no parcel of land thus con-
demned shall exceed one acre within or ten acres without the
corporate limits of any town in said county. No dwelling, yard,
garden or orchard shall be invaded, nor any space within one
hundred feet of a dwelling, unless a public street or county road
lie between said dwelling and the lot being condemned, in which
case it shall be lawful to condemn the said land up to the street
line opposite such dwelling; provided, further, however, that
the owner of any property sought to be condemned may, by
notice in writing filed with the papers in the above suit, waive
any of the above exceptions.
2. All acts or parts of acts in conflict herewith, are hereby
repealed.
8. An emergency existing by reason of the fact that the
county school board of Arlington county desires to im-
mediately condemn property for school purposes, this act shall
be in force from its passage.
