Chap. 510.—An ACT to erect a library building and auditorium as a memorial
to the soldiers, sailors, marines and women who served in the world war,
and to appropriate money therefor; to dedicate as and for public streets
and highways upon certain conditions a strip of land fifteen feet in width
lying on the southern side of the Capitol square in the city of Richmond,
' needed by the city of Richmond for the widening of Bank street. To allow
the library board to borrow money, issue bonds therefor and secure the
same; and to allow the State board of education, from time to time, to invest
the cash in hand of the literary fund in said bonds. [S B 155]

Whereas, pursuant to a senate joint resolution adopted at the extra
session of the general assembly of Virginia of nineteen hundred and
‘nineteen, a commission was appointed to consider and to recommend
to the general assembly the erection of a suitable State memorial to
the soldiers, sailors and marines of Virginia who lost their lives in
the world war, and
Whereas, said commission has recommended as a memorial worthy
of the State and the glorious deeds of her sons the erection of a State
library building to be designated and known as the Memorial Library,
to be located in the city of Richmond, and to be in lieu of and to
answer the purposes of the present library building, where its priceless
archives are now in daily danger of destruction by fire, which recom-
mendation, however, is conditioned upon the conveyance by the city
of Richmond to the library board of the parcel of land hereinafter
described and located adjacent to the Capitol grounds, on which lot a
commodious, artistic and fireproof library building may be erected,
as well as an auditorium for the meetings of the State organizations
of the soldiers, sailors and marines of the world war, and where other
public meetings of citizens may be held; now, therefore:
1. Be it enacted by the general assembly of Virginia, That upon
the grant and conveyance in fee simple and free from all encum-
orances by the city of Richmond of the square or parcel of land in
said city bounded by Eleventh, Twelfth, Capitol and Broad streets, to
the library board, authority to make said conveyance being hereby
yranted the said city of Richmond and the acceptance of said gift
by the library board with the approval of the attorney general oi
Virginia as to the form of conveyance, there be and is hereby appro-
priated out of any moneys in the State treasury not otherwise appro-
priated the sum of one hundred and twenty-five thousand ($125,000.00)
dollars for the appropriation year ending February 28, 1921, and one
hundred and twenty-five thousand ($125,000.00) dollars for the appro-
priation year ending February 28, 1922.
And in addition to the above amount the State pledges her faith
as far as she can under the Constitution of the State, that she will
by the legislature in 1922 appropriate the further sum of one hun-
dred and twenty-five thousand ($125,000.00) dollars for the appropria-
tion year ending February 28, 1923, and one hundred and twenty-five
thousand ($125,000.00) dollars for the appropriation year ending Feb-
ruary 29, 1924, for the purpose of the erection on said lot of said
Memorial Library building and a suitable auditorium for the meet-
ings of the soldiers, sailors, marines and women who served in the
world war and where other public meetings of citizens may be held.
The amounts so appropriated shall be paid over to the treasurer ot
the State and deposited by him to the credit of the Memorial Library
fund, and be paid out by him as needed for the erection and equip-
ment of said building in accordance with the terms and conditions
of section three hundred and fifty-nine of the Code of nineteen hun-
dred and nineteen: Provided, however, that this act shall be void
and of no effect in the event that the grant and conveyance by the
city of Richmond as herein provided shall not be made on or before
the thirty-first day of December, nineteen hundred and twenty-one.

eral purposes.
It is further enacted that upon the grant and conveyance in fet
simple and free of incumbrances by the city of Richmond of the square
or parcel of land described in the foregoing part of this section, and it:
acceptance by the library board, with the approval of the attorney
general of Virginia as to the form of conveyance as aforesaid, that :
strip or parcel of land fifteen feet in width, now composing the
extreme-southern portion of the Capitol Square shall be dedicated a:
and for a public street and highway, the metes and bounds of whic!
are shown on a plan on file in the office of the director of public work
of the city of Richmond, entitled: “Proposed widening of Banl
street from Ninth street to Twelfth street and Twelfth street fron
Bank street to Franklin street,” dated January fourteenth, ninetee:
hundred and twenty, and marked “10875-A-5,” said strip of land bein:
needed by the city of Richmond for the widening of Bank stree
between Ninth and Twelfth streets.
The dedication aforesaid shall, in addition to the foregoing cor
dition, be made upon the following stipulations.
First: That the city of Richmond shall, by a proper ordinance,
accept the said dedication upon the terms and conditions herein con-
tained, and shall make the necessary appropriation to improve and
make available, for public use, the said strip or parcel of land as a
part of said Bank street, and shall bear all the expenses thereof.
Second: That such improvements shall be in accordance with
plans and specifications approved by the governor of Virginia, and
shall include the removal and restoration of the present gateways
and enclosure of the said Capitol Square so far asthe same shall
be disturbed along the new lines established by virtue of this act.
Third: All materials used in and about the making of the im-
provements and the restoration authorized and required by this act
shall be satisfactory to the superintendent otf grounds and buildings
of the State of Virginia, and the work shall be cone under his super-
vision.
The library board is hereby empowered and authorized to borrow
money to an amount not exceeding one million, five hundred thousand
($1,500,000.00) dollars, to make and issue its bonds therefor in such
amounts and at such rate of interest not to exceed the legal rate
as the library board may determine, and to secure the same by mort-
gage or deed of trust on said lot or square and any building or build-
ings which may be hereafter erected thereon, the proceeds thereof
to be paid out according to the conditions of section three hundred
and fifty-nine of the Code of nineteen hundred and nineteen, and used
exclusively for the building of said library and auditorium and the
equipment, furnishing and books thereof.
The plans for said building or buildings shall be first approved
by the art commission of Virginia, and shall be erected under the
joint supervision and direction of said library board and a war memo-
rial commission, two to be appointed by the governor, two members
of the senate and two members of the house of delegates to be ap-
pointed by the presiding officers thereof, respectively.
The proceeds from the sale of said bonds shall be paid to the
treasurer of the State, and deposited by him to the credit of the
Memorial Library fund and paid out by him in accordance with the
terms and requirements of section three hundred and fifty-nine of
the Code of nineteen hundred and nineteen.
Said bonds shall run for thirty years from their date and out of
any appropriation which may hereafter be made by the general
assembly for the support and maintenance of said Memoral Library
and auditorium, there shall first be set apart, annually, a sum suf-
ficient to pay the interest accruing on said bonds and to constitute a
sinking fund for the liquidation of the principal of the same; and the
said sum shall be applied to no other purpose or object whatever.
5. After providing for the requirements and demands for the
erection or enlarging of school houses in the school districts and
cities, and the memorial libraries to be erected in the counties, cities
and towns of the State, the State board of education is hereby author-
ized to invest from year to year so much of the balance of any moneys
belonging to the literary fund and in hand for investment as they
may deem proper in the above described bonds.
6. Said Memorial Library and auditorium shall be the depository
of all the archives of the soldiers, sailors, marines and women who
served in the world war and other wars, and the State library board
may acquire by gift or otherwise. such archives and all flags and
other memorials; and therein, under the direction and rules of said
library board, the various localities of the State may erect suitable
tablets to those of the sons of such locality as made the supreme
sacrifice in said world war or other wars in which Virginia’s sons
have served. -
The sums hereby provided shall be paid out of the general fund
of the State treasury next after the appropriations carried in the
general appropriation act.

Note.—The Supreme Court of the United States entered a decree on the
6th day of March, 1911, fixing the principal of the debt due by West Virginia
on such certificates at $7,182,507 46 The question of the interest to be paid on
the above principal sum found to be due was not then determined. The sugges-
tion of the court that the matter of interest should be adjusted between the
parties litigant resulted in a commission being appointed by West Virginia to
consider the question with the commissioners appointed by Virgnia, but was
unavailing; and this matter, as well as the claim of West Virginia for an interest
in the assets charged as held by the old State, was referred by the court to a
special master for report thereon. On the 14th day of June, 1915, the court,
acting upon such report, amended its former decree and gave judgment for
$4,215,622.28 of principal and $8,176,307.22 of interest, with 5 per cent interest per
annum on the total amount from July 1, 1915, and on April 1, 1919, the State
of West Virginia passed an act and settled her debt as follows: By paying to
the Virginia Debt Commission $1,062.867.16 in cash and $13,500,000 in 314 per
cent interest-bearing bonds, such interest payable July Ist, and January Ist. of
each year. Such bonds payable in twenty (20) years, West Virginia holding
$1, 133,500.00 to meet certificates not presented to the Virginia Commission prior
to April 1, 1919, the date of the act of settlement.
