Chap. 456.—An ACT to authorize and empower the board of supervisors of
Floyd county to borrow the sum of $215,000.00 and to issue bonds therefor
for the repair, improvement and construction of certain roads and bridges
in the magisterial districts of said county. [H B 452]
Approved March 24, 1920.
1. Be it enacted by the general assembly of Virginia, That the
board of supervisors of Floyd county be, and it is hereby, authorized
and empowered to issue bonds in the name of the county of Floyd
for the purpose of surveying, repairing, constructing and improving
certain roads and building bridges thereon in Locust Grove, Little
River, Court House, Burk’s Fork, Indian Valley and Alumridge magis-
terial districts as hereinafter set forth, to-wit: The sum of forty
thousand dollars for Locust Grove magisterial district, the sum of
forty thousand dollars for Little River magisterial district, the sum of
fifty-five thousand dollars for Court House magisterial district, the
sum of thirty thousand dollars for Burk’s Fork magisterial district,
the sum of twenty-five thousand dollars for Indian Valley magisterial
district and the sum of twenty-five thousand dollars for Alumridge
magisterial district in said county.
2. The said board of supervisors are authorized and empowered,
after issuing said bonds, or any of them, when the next levy 1s made,
or tax imposed in said county, to levy a tax on all property liable to
county and district tax in each magisterial district of the county in
which the proceeds of the bonds have been or are to be expended.
including all such property located or the situs of which for taxation
is within the limits of any incorporated town situated within such dis-
trict, to pay the interest on said bonds so issued and to create a sink-
ing fund to redeem the principal of said bonds at maturity.
3. The said bonds, when issued, shall be delivered to the treas-
urer of Floyd county, and when said bonds are sold he shall deliver
the bonds to the purchaser or purchasers, and these bonds shall be
sold and marketed as now provided by general law for the sale and
marketing of county road bonds. The said bonds, when issued, shall
be signed by the chairman of the board of supervisors and counter-
signed by the clerk of said board; and the seal of the board affixed:
these bonds shall be issued in serial number and shall be payable in
from one to twenty years, one-twentieth of the principal of said bonds
shall become due and payable every year from the date of issue.
4. The said board of supervisors are hereby authorized and em-
powered to make, issue and sell all of said bonds from time to time as
the work progresses in the surveying, constructing, repairing and 1m-
proving the roads herein mentioned and described and bridges on said
roads, but all said bonds shall be issued and sold and all work done
and completed on said roads and bridges mentioned in this act within
forty-two months from the passage of this act, but no bonds shall be
sold for less than par value thereof and shall not bear a greater rate of
interest than six per centum per annum, interest to be paid on said
bonds semi-annually, bonds to be issued in denominations of not less
than one hundred dollars and not more than one thousand dollars.
5. All money realized from the sale of said bonds under the pro-
visions of this act shall be received by the treasurer of said county and
he shall keep said money separate from any other money that may
come into his hands as treasurer and shall keep the money separate in
each magisterial district and for his services required of him by this
act shall be paid one-fourth of one per centum of the amount thus
coming into his hands.
6. The board of supervisors of said county of Floyd shall issue
and make sale as hereinbefore stated of bonds in the sum of forty
thousand dollars for the Locust Grove magisterial district in said
county; the sum of forty thousand dollars for the Little River magis-
terial district in said county ; the sum of fifty-five thousand dollars for
the Court House magisterial district in said county; the sum of thirty
thousand dollars for the Burk’s Fork magisterial district in said county ;
the sum of twenty-five thousand dollars for the Indian Valley magis-
terial district in said county, and the sum of twenty-five thousand
dollars for the Alumridge magisterial district in said county, but the
full faith and credit of the entire county of Floyd is to be pledged to
the payment of all the said bonds of each district and the interest on
the same.
7. The board of supervisors of the said county of Floyd may
within three months from the passage of this act pass a resolution au-

thorizing the issue of said bonds and the purpose for which said bonds
are to be isued; and when said bonds are issued they are to be made
payable to bearer and shall be negotiable, and each bond shall state
when due and payable and shall be made payable at the office of the
treasurer of Floyd county; and said board of supervisors shall cause
to be printed on each bond the name of the magisterial district for
which it is issued, but that the full faith and credit of the entire county
of Floyd is pledged to the payment of said. bond and the interest on
same, and that said bond is issued in pursuance of a resolution of
the board of supervisors of Floyd county and in pursuance of authority
authorizing and empowering the board of supervisors in the county of
Floyd to issue said bonds and to market said bonds as the law requires
and in pursuance of this act. The purchasers of said bonds shall not
be responsible in any way for the application of the proceeds thereof.
8. The board of supervisors of said county of Floyd is hereby
authorized and empowered to expend within forty-two months from
the passage of this act the money from the sale of the bonds of each
magisterial district on the road specifically mentioned and described in
said district, except Alumridge district, and the said board shall keep
an itemized account of all work done and money expended in the con-
struction, surveying, repairing and improving the road and bridges on
said road in each magisterial district.
The said board is authorized and empowered to appoint all over-
seers, foremen and subordinates it considers necessary to carry out the
provisions of this act and to have the work done on said roads and
bridges on the same herein mentioned. The said board shall employ
a civil engineer, subject to approval of the State highway commissioner,
to assist it in having the work performed mentioned in this act, and
shall pay to him not exceeding twenty-five hundred dollars per annum,
while the work is being done on the roads and bridges mentioned in
this act.
The said board is hereby authorized to purchase for each magisterial
listrict named in this act all the necessary tools, implements and
nachinery to have the work performed in each of the magisterial dis-
ricts named in this act, but the cost of the tools, implements and
nachinery shall not exceed two thousand dollars in any one magisterial
listrict, to be used for the purposes mentioned in this act. It shall
yay for the tools, implements and machinery out of the funds derived
‘rom the sale of bonds mentioned in this act. Each magisterial dis-
rict shall pay its proportionate part of the cost of all tools, implements
ind machinery bought for the respective district. Each supervisor shall
ye allowed a sum not to exceed the sum of four dollars per day while
ie is actually and personally engaged in having the work done men-
ioned in this act.
9. Before any work is actually commenced on any road mentioned
ind described in this act the said board shall have the road surveyed
nd located by a civil engineer, provided said roads have not already
een surveyed and located.
The said board shall have the amount of money herein designated
pent on the roads mentioned in this act in a fair and equitable way,
and shall cause to be hauled and distributed where necessary on the
said road, sand, gravel and any other hard substance that will improve
the roads and cause the same to be dry and solid; it shall cut out as
many of the steep grades on each road as possible and shall see that no
road herein mentioned exceeds four degrees.
10. The said board shall make out an itemized monthly account
of all work done by it or under its charge or direction, showing the
teams, tools, implements and machinery used and the number and names
of the laborers employed and dates on which the work was done and
the number of hours worked by each laborer, and shall then issue a
warrant on the treasurer of Floyd county and give the same to the
person performing the labor and the treasurer of the county shall pay
the same out of the funds arising from the sale of said bonds of the
magisterial district in which the work and labor have been performed.
11. The said board of supervisors shall cause to be kept by the
clerk of the board of supervisors a book in which an itemized account
of all work done, all tools and implements and machinery purchased
and all money expended on the roads and bridges mentioned in this
act and published in the manner provided by law for the publication of
other expenditures. The board of supervisors shall devise a system of
bookkeeping in order to carry out the intention of this act, and require
the clerk of said board to keep said books as directed, and also require
the treasurer of said county to keep his books in accordance with rules
and regulations laid down by them, the clerk of said board shall be
paid the sum of one hundred dollars per year for his services required
of him by this act.
12. The board of supervisors of Floyd county, in conjunction with
the civil engineer hereinbefore provided for, shall construct, improve
and repair the following roads and bridges in the several magisterial
districts of said county:
(a) The Bent Mountain road from the Roanoke county line to
Little River distriet line, recently surveyed by the State highway com-
missioner, and bridges thereon in Locust Grove magisterial district.
and no other, out of the funds derived from the sale of the bonds of
said magisterial district mentioned in this act, and shall expend on
said road herein mentioned of said funds the sum of forty thousand
dollars, less amount actually paid for tools, implements and machinery.
(b) -In Little River magisterial district, and no other, out of the
funds derived from the sale of the bonds of said magisterial district
mentioned in this act and shall expend on said road herein mentioned,
the sum of forty thousand dollars, less the amount actually paid for
tools, implements and machinery, on the same Bent Mountain road in
Little River magisterial district from Locust Grove district line to Court
House district line, as recently surveyed by the State highway com-
missioner.
(c) In Court House magisterial district, and no other, out o!
the funds derived from the sale of the bonds of said magisterial dis-
trict mentioned in this act and shall expend on the road herein men-
tioned the sum of fifty-five thousand dollars, less the amount actualls
paid for tools, implements and machinery on the said Bent Mountair

road from Little River district line at Pine creek to intersect with
Floyd and Franklin turnpike, and on said Floyd and Franklin turnpike
to Floyd county court house and from said court house on the Floyd
and Carroll turnpike to Burk’s Fork district line, as recently surveyed
by the State highway commissioner.
(d) In Burk’s Fork magisterial district, and no other, out of the
funds derived from the sale of the bonds of said magisterial district
mentioned in this act, and shall expend on the road herein mentioned
the sum of thirty thousand dollars less the amount actually paid for
tools, implements and machinery on the Floyd and Carroll turnpike
in said Burk’s Fork district between Court House district line and
Carroll county line, as recently surveyed by the State uliad com-
missioner.
‘(e) In Indian Valley magisterial district and no other, ‘out of
the funds derived from the sale of the bonds of said magisterial dis-
trict mentioned in this act and shall expend on the road herein men-
tioned the sum of twenty-five thousand dollars, less the amount actually
paid for tools, implements and machinery, on the toad beginning at
the Montgomery county line at the bridge at mouth of Indian creek
and running by Indian Valley church, Indian Valley postoffice, to Car-
roll county line, being the road recently surveyed by the State highway
commissioner.
(£) In Alumridge magisterial district it shall take into considera-
tion the importance and travel on the roads and bridges it improves.
and shall make a fair and equitable distribution of the funds from
the sale of the bonds in said magisterial district in constructing and
improving the roads and bridges in said district. It may expend the
sum of twenty-five thousand dollars, less the amount paid for tools
implements and machinery, on the roads and bridges of said district
13. An emergency existing, this act shall be in force from its
passage.
