CHAP. 419.—An ACT to amend and re-enact section 4248 of the Code of Vir-
-ginia. (H B lll)

1. Be it enacted by the general assembly of Virginia, That sec-
tion forty-two hundred and forty-eight of the Code of Virginia be
amended and re-enacted so as to read as follows:
Sec. 4248. Punishment for fraudulent procurement of policy.—
Any agent, physician, or other person who shall knowingly secure
or cause to be secured a policy of life insurance on any person with-
out his knowledge or consent, or by means of misrepresentations,
false, fraudulent, or untrue statements be instrumental in securing a
policy of life insurance on any person, not in an insurable condition,
shall be deemed guilty of a misdemeanor, and said certificate or
renewal so secured shall be absolutely void if the insured participated
in such fraud; provided, however, that when the policy of insurance
shall contain a clause or provision fixing a period of time after the
expiration of which the said policy shall be incontestable except for
certain causes therein stated, no ground of defense not so stated shall
be interposed in any action or suit on a policy of insurance after the
expiration of the time limit fixed in the policy sued on.
