Chap. 363.—An ACT to amend and re-enact sections twelve hundred and fifteen.

1. Be it enacted by the general assembly of Virginia, That sec-
tions twelve hundred and fifteen, twelve hundred and sixteen and
twelve hundred and seventeen of the Code of Virginia be and are
amended and re-enacted so as to read as follows:
Sec. 1215. Definition of varieties of ice cream and milk.—lIce
cream is a frozen product made from cream, milk and sugar, with or
without a natural flavoring, and contains not less than eight per
centum of milk fat.
Fruit ice cream is a frozen product made from cream, milk, sugar
and sound, clean, mature fruits, and contains not less than eight per
centum of milk fat.
Nut ice cream is a frozen product made from cream, milk, sugar
and sound, non-rancid nuts, and contains not less than eight per
centum of milk fat.
In the manufacture of ice cream the use of a small amount of
gelatine, not exceeding four ounces to ten gallons of cream, is per-
mitted, together with sugar and eggs, and such coloring matter as
permitted under the national pure food laws.
Condensed skimmed milk is skim milk from which a considerable
portion of water has been evaporated.
Sec. 1216. Unlawful to sell ice cream which does not meet the
fixed standards.—It shall be unlawful for any person, firm or cor-
poration to offer or expose for sale any ice cream or condensed
skimmed milk which does not meet the standards fixed by the pre-
ceding section for the article or articles manufactured, exposed or
offered for sale as ice cream or condensed skimmed milk.
Whenever condensed skimmed milk is offered or exposed for sale
in this State, each can or container shall be plainly and clearly marked
in letters of appropriate size, ‘“CCondensed Skimmed Milk.”
Sec. 1217. Penalty for violation of the two preceding sections.—
Any manufacturer, company,.or person, who shall violate any of the
provisions of the two preceding sections, shall be guilty of a misde-
meanor and for such offense shall be fined for the first offense not
more than twenty-five dollars, and for each subsequent offense, not
exceeding one hundred dollars.
