Chap. 261.—An ACT to authorize, empower and require the board. ail: super-
visors of Grayson county to borrow the sum of $90,000.00 and to issue bonds
therefor for the repair, improvement and consfruction of certain roads and
bridges in Wilson, Elk Creek and Old Town magisterial districts of said
county; to provide for the expenditure of the funds raised by such bond
issue; to authorize the purchase of machinery and tools necessary therefor:
to authorize the employment of civil engineers, road builders and labor; to
specify the roads and parts thereof to be constructed and the amounts to be
expended thereon; to provide for imposing a tax on all property, county
and district, including property in any incorporated town situated within
the above named districts, for the purpose of paying the interest and prin-
cipal of such debt; to do all things necessary, needful or incidental to the
main purposes of this act; and to declare an emergency. [S B 293]

1. Be it enacted by the general assembly of Virginia, that the
board of supervisors of Grayson county be, and it is hereby author-
ized, empowered and required to issue bonds in the name of the county
of Grayson for the purpose of surveying, repairing, constructing and
improving certain roads and building bridges thereon in Wilson, Elk
Creek and Old Town magisterial districts as hereinafter set forth, to-
wit: The sum of thirty thousand dollars for Wilson magisterial dis-
trict, the sum of thirty thousand dollars for Elk Creek magisterial
district and the sum of thirty thousand dollars for Old Town magis-
terial district in said county of Grayson.
2. The said board of supervisors are authorized, empowered and
hereby required, after issuing said bonds, or any of them, when the
next levy is made, or tax imposed in said county, to levy a tax on all
property liable to county and district tax in each magisterial district
of the county in which the proceeds of the bonds have been or are to
be expended, including such property located on the situs of which for
taxation is within the limits of any incorporated town situated within
such district, to pay the interest on said bonds so issued and to create
a sinking fund to redeem the principal of said bonds at maturity.
3. The said bonds, when issued, shall be delivered to the treas-
urer of Grayson county and when said bonds are sold he shall deliver
the bonds to the purchaser or purchasers and these bonds shall
be sold and marketed as now provided by general law for the sale and
marketing of county road bonds. The said bonds, when issued, shall
be signed by the chairman of the board of supervisors and counter-
signed by the clerk of said board and the seal of the board affixed;
these bonds shall be issued in serial number and shall be payable from
one to ten years, one-tenth of the principal of said bonds shall become
ue and payable every. year from date of issue. Three thousand
($3,000.00) dollars par value of the bonds issued for each magisterial
district to be paid and retired each year.
4. The said board of supervisors are hereby authorized, empow-
ered and required to make, issue and sell all of said bonds in two in-
stallments of fifty per centum of the bonds authorized to be issued
by this act at such times as the board of supervisors in its discretion
may determine, but all said bonds shall be issued and sold and all
work done and completed on said roads and bridges mentioned in this
act within two years from the passage of this act, but no bonds shall
be sold for less than par value thereof and shall not bear a greater
interest than six per centum per annum, interest to be paid on said
bonds semi-annually, bonds to be issued in denominations of not less
than one hundred dollars and no more than one thousand dollars.
5. All money realized from the sale of’said bonds under the pro-
vision of this act shall be received by the treasurer of said county and
he shall keep said money separate from any other money that may
come into his hands as treasurer and shall keep the money separate
in each magisterial district and for his services required of him by
this act he shall be paid according to law.
6. The board of supervisors of said county of Grayson shall issue
and make sale as hereinbefore stated of bonds in the sum of thirty
thousand dollars for the Wilson magisterial district in said county and
the sum of thirty thousand dollars for the Elk creek magisterial dis-
tract of the said county and the sum of thirty thousand dollars for the
Old Town magisterial district in said county, but the full faith and
credit of the entire county of Grayson is to be pledged to the payment
of all the said bonds of each district and the interest on the same.
7. The board of supervisors of the said county of Grayson shall
at their next monthly meeting after the passage of this act pass a
resolution authorizing the issue of said bonds and the purpose for
which said bonds are to be issued, and when said bonds are issued
they are to be made payable to bearer and shall be negotiable and
each bond shall state when due and payable and shall be made payable
at the office of the treasurer of Grayson county; and said board of
supervisors shall cause to be printed on each bond the name of the
magisterial district for which it is issued, but that the full faith and
credit of the entire county of Grayson is pledged to the payment
‘of said bond and the interest on same, and that said bonds are issued
in pursuance of a resolution of the board of supervisors of Grayson
county and in pursuance of authority authorizing, empowering and
requiring the board of supervisors of the county of Grayson to issue
said bonds and to market said bonds as the law requires and in pur-
suance of this act. }
8. Each member of the board of supervisors of said magisterial
districts of said county of Grayson is hereby authorized, empowered
and required to expend within two years from the passage of this
act the money from the sale of the bonds of his magisterial district
on the roads specifically mentioned and described in his district and
each supervisor shall keep an itemized account of all work done and
money expended in the construction, surveying, repairing and improv-
ing the roads and bridges on said roads designated in his magisterial
district.
Each supervisor is authorized, required and empowered to appoint
all overseers, foremen and subordinates as he considers necessary to
carry out the provisions of this act and to have the work done on said
roads and bridges on the same herein mentioned and specified and
shall pay to them not more than twenty-five cents per hour, and each
supervisor of said magisterial districts shall employ a civil engineer
or some man well versed in road building to assist him in having the
work performed on the roads and bridges of said roads specifically
mentioned in this act and shall pay to him not exceeding six dollars
($6.00) per day, while the work is being done on the roads and bridges
mentioned in this act, and no supervisor shall pay more than twenty-
five cents per hour to each adult laborer for work, and not more than
fifty cents per hour for two horse team wagon and driver.
Each supervisor of said magisterial districts is hereby authorized
and required to purchase all the necessary tools, implements and ma-
chinery that is necessary to have the work performed on the roads
and bridges in his district mentioned in this act, but he shall not pay
more than two thousand dollars for a complete outfit of tools, imple-
ments and machinery to be used by him for the purposes mentioned
in this act; he shall pay for tools, implements and machinery out of the
funds from sale of bonds mentioned in this act. Each supervisor shall
be allowed the sum of four ($4.00) dollars per day, while he is actually
engaged in having the work done in his district, mentioned in this act.
9. Before any work is actually commenced on any road mentioned
and described in this act the supervisor of the district in which the

road is located shall have the road surveyed and located by a civil
engineer or by some person, who is thoroughly competent to survey
and locate public roads, provided said roads have not already been
surveyed and located.
The supervisor of each magisterial district shall have the amount
of money herein designated spent on each road mentioned in this act
ina fair and equitable way and shall distribute the work over the
entire road and shall cause to be hauled and distributed where neces-
sary on each of said roads, sand, gravel and any other hard sub-
stance that will improve the road and cause the same to be dry and
solid; he shall cut out as many of the steep grades on each road as
possible and shall see that no road herein mentioned exceeds five
degrees.
10. Each supervisor shall make out an itemized account of all
work done by him or under his charge or direction, showing the
teams, tools, implements and machinery used and the number and
names of the laborers employed and dates on which the work was
done and the number of hours worked by each laborer and shall then
issue a warrant on the treasurer of Grayson county and give the same
to the person performing the labor and the treasurer of the county
shall pay the same out of the funds arising from the sale of said
bonds of the magisterial district in which the work and labor has been
performed.
11. The said board of supervisors shall cause to be kept by the
clerk of the board of supervisors a book in which an itemized account
of all work done, all tools and implements and machinery purchased
and all money expended on the roads and bridges mentioned in this
act and published in the manner provided by law for the publication of
other expenditures. The board of supervisors shall devise a system
of bookkeeping in order to carry out the intention of this act, and
require the clerk of said board to keep said books as directed and
also require the treasurer of said county to keep his books in ac-
cordance with rules and regulations laid down by them, the clerk of
said board shall be paid the sum of one hundred ($100.00) dollars
per year for his services required of him by this act.
12. The supervisor of the Old Town magisterial district, in con-
junction with the civil engineer, or the man well versed in road building
whom he shall employ, shall construct, improve and repair the follow-
ing roads and bridges thereon in his magisterial district, and none
other, out of the funds derived from the sale of the bonds of his
magisterial district mentioned in this act and shall expend on each
road herein mentioned of said funds the following amount, to-wit:
(a) The sum of five thousand dollars on the public road from
Reavis’ mill via Baywood and Peach Bottom to the North Carolina
line.
(b) The sum of five thousand dollars on the public road from
Galax via Fairview to the North Carolina line at Low Gap.
(c) The sum of two thousand dollars on the public road from
Baywood to Boyer’s Ferry.
(d) The sum of three thousand dollars on the public road from
Fries to Galax.
(e) The sum of five thousand and five hundred dollars on the
public road from Fries to mouth of Boags branch via Rural Home,
M. C. Porter’s, thence down Boags branch to the mouth of it.
(f) The sum of fifteen hundred dollars on the public road from
mouth of Elk creek to Pleasant Hill church.
(zg) The sum of three thousand dollars on a public road from
near Reavis’ mill up Meadow creek to Dalhart via A. J. Todd’s place.
(h) The sum of three thousand dollars on the road from Low
Gap, via Snow Hill to Carroll county line near Thomas Higgins.
13. The supervisors of the Elk Creek magisterial district, in con-
junction with the civil engineer, or the man well versed in road
building, whom he shall employ, shall construct, improve and repair.
the following roads and bridges thereon in his magisterial district,
and none other, out of the funds derived from the sale of the bonds of
his magisterial district mentioned in this act and shall expend on
each road herein mentioned of said funds the following amount,
to-wit :
(a) The sum of two thousand dollars on the road from Boyer’s
Ferry to D. P. Poole’s store.
(b) The sum of ten thousand dollars on the public road from
the North Carolina line in the Sparta road via Independence and Elk
creek to the Wythe county line at Dry Run Gap.
(c) The sum of thirty-five hundred dollars on the road from
Elk creek, commencing at T. W. Mitchell’s store via James Tood
Parsons’, Comer’s Rock to the: Elk Creek and Wilson magisterial dis-
trict line, near G. M. Cornett’s.
(d) The sum of four thousand dollars on the road from Elk
Creek at T. W. Mitchell’s store via Catron’s mill to Old Town magis-
terial district line near Pleasant Hill.
(e) The sum of three thousand dollars on the public road com-
mencing at Spting Valley post office, via S. L. Bourne’s, across Briar
Patch mountain to Catron’s mill.
(f{) The sum of three thousand dollars on the public road com-
mencing at Peach Bottom church via I. B. Bryant’s, Chestnut Hill
school house, Hackler’s store and to intersect the Elk Creek road at
Catron’s mill. :
(g) The sum of one thousand dollars on the road from Troy’s
chapel to Chesley Ward place. , ,
(h) The sum of fifteen hundred dollars on a public road leading
from Eugene Cornett’s via Bethel church to L. P. Stamper’s via P.
W. Harrington’s.
14. The supervisors of the Wilson magisterial district, in con-
junction with the civil engineer, or the man well versed in road build-
ing, whom he shall employ, shall construct, improve and repair the
following roads and bridges thereon in his magisterial district, and
none other, out of the funds derived from the sale of the bonds of his
magisterial district mentioned in this act and shall expend on each road
herein mentioned of said funds the following amount, to-wit:
(a) The sum of three thousand and five hundred dollars on the
public road from Ellis Livesay’s via Flat Ridge post office to Trout-
dale via Laurel creek.
(b) The sum of four thousand dollars on the public road leading
from Comer’s Rock to Grant, commencing at the Elk Creek and Wil-
son magisterial district line near G. W. Cornett’s via of H. A. Hoff-
man’s.
(c) The sum of two thousand dollars on the road from J. A.
Phipps’ store to the ford in Middle Fox creek at the J. A. Hash place
via H.,L. Phipps’. and Grubbs chapel.
(d) The sum of thirty-five hundred dollars on the public road
from W: J. Phipps’ store to the Pickle ford via the Tom Hatch mill;
thence up Big Fox creek.
(e) The sum of three thousand dollars on the public road from
mouth of Wilson to Rugby, via John W. Parson’s place and Grassy
creek.
(f) .The sum of two thousand dollars on the public road from
Ham’s ford to mouth of Wilson via Maple Shade high school.
(g) The sum of three thousand dollars on the public road from
Grant to the State line via Rugby.
(h) The sum of seven thousand dollars on the public road from
Rugby to White Top Gap. The said sum of seven thousand dollars
shall be excluded from the provisions of this act, the road described
in paragraph (h) supra, in the event that the State in the near future
will build this road with Federal aid, in which latter event the sum
of seven thousand dollars provided to be expended on said road shall
be equally expended on roads mentioned in paragraphs (a), (b), (c),
(d), (e), (£), and (g) in Wilson magisterial district.
1414. The sums of five thousand dollars and two thousand dollars
mentioned in paragraphs (a) and (c) in Old Town magisterial district,
and two thousand dollars mentioned in paragraph (a) in Elk Creek
magisterial district shall be excluded from the provisions of this act,
in the event that the State highway commissioner shall locate the
State road to be constructed with Federal aid, from Galax, Independ-
ence to a point near Damascus to connect with route No. 10 via Bay-
wood and Boyers Ferry—said road mentioned. and described in acts
of assembly approved January thirty-first, nineteen hundred and
eighteen. In which latter event the said sums of five thousand dollars
and two thousand dollars mentioned in paragraphs (a) and (c) in Old
Town magisterial district, and two thousand dollars mentioned in
paragraph (a) in Elk Creek magisterial district shall be expended
on the public road leading from Fries to Independence on what is
known as the “river route” commencing at mouth of Boags branch to
Independence by way of David Lane place. The said amounts of
five thousand dollars and two thousand dollars mentioned in para-
graphs (a) and (c) in Old Town magisterial district to be expended
on that portion of said road as is tocated in Old Town magisterial dis-
trict, and said amount of two thousand dollars mentioned in paragraph
(a) in Elk Creek magisterial district shall be expended on that por-
tion of said road as is located in Elk Creek magisterial district.
15. This act shall be construed as mandatory, tequiring the board
of supervisors of Grayson county to issue the bonds, to lay a levy on
the property of each magisterial district liable to county and district
tax to pay for the bonds and the interest on same, to purchase the
tools, implements and machinery necessary to have the work per-
formed mentioned in this act and to require the supervisors and each
member thereof to have all the work done on the roads and bridges
on said roads mentioned in this act.
15-A. The purchasers of the bonds authorized to be issued by
this act shall in no event be required to see to the application of the
purchase money.
16. This act shall be construed to the end that its purpose shall
be fully carried out.
17. In view of the fact that the road mentioned and described
and laid out in each magisterial district in this act are badly in need
of repair and improvement, an emergency is declared to exist and
this act shall be in force from its passage.
