CHAP. 53.—An ACT to create for the county of Appomattox a road board
and to prescribe the powers and duties of such board and thereby to
provide for controlling, constructing, working and keeping in repair
‘the public roads and bridges within said county and to empower and
authorize the levy of taxes for road and bridge purposes in said
county. [H B 14]

1. Be it enacted by the general assembly of Virginia, That
a road board for the county of Appomattox, to be known as the
county road board, is hereby created, which shall be composed of
the supervisors of the several districts of the said county, it being
the intention of this act to make and constitute the said board
of supervisors the county road board.
2. The said county road board shal] have control of all pub-
lic roads within the county and shall have the power and be
charged with the duty of controlling, supervising, managing,
building, improving and keeping in order all the public roads
and bridges within said county, and shall make and prescribe
such rules, regulations, specifications and directions as it shall
deem best for building, keeping in order and repairing such
roads and bridges.
As used in this act, the term “road” or “roads” shall be con-
strued to include highways, streets, avenues and roads; and the
term “bridge” or “bridges” shall be construed to include bridges,
viaducts and causeways.
3. The said county road board may appoint such superin-
tendents and engineers and such servants and other employees
as the board may deem necessary for the purposes herein set out
and pay out of the fund hereby created such wages and salaries
as they may deem proper, and the said board is further authur-
ized and empowered to purchase or hire machivery, teams, tools
and such »ther equipment and to make such contracts as the said
county road board may deem wise, and the said county road
board is further authorized and emipowered to do all other things
which may be deemed by them necessary for the proper con-
struction, repair and upkeep of the roads and bridges of said
county.
4. The said county road board shall, at its first meeting,
elect one of its members chairman of said road board, and in
each month hold a meeting at such time and place in the county
as they may designate for the discharge of their duties, and may
appoint and hold such other regular or special meetings at such
times and places as may be necessary for that purpose.
Each member of the said county road board shall be paid the
same compensation and mileage as is now allowed by law to the
members of the board of supervisors; provided, however, that
the said board shall not draw pay for more than thirty days in
one year; but such compensation shall be in addition to any
amount he is paid as a member of the board of supervisors, it
being the intention of this act that compensation as member of
the board of supervisors shall be separate and distinct from any
compensation as member of the county road board.
5. The clerk of the county of Appomattox shall perform the
duties of clerk to said county road board and receive for his ser-
vices such sum as said board may deem right and proper.
The board of supervisors of Appomattox county shall
annually (when it makes its annual levies for other purposes)
levy and appropriate for general road purposes under this act
a tax upon the property, rea] and personal, assessed for taxation
in the county, which shall be applied to the construction, work-
ing, keeping in order and repairing of the public roads and
bridges, including the compensation of the members of the county
road board and the subordinates appointed or employed by them
under this act, and all of said fund shall be expended upon
orders of the county road board herein created. Such tax shall
not. exceed one dollar upon every hundred dollars in value of the
real and personal property assessed for taxation in the county,
and the same shall be collected by the treasurer of the county
as other levies are collected, and be accounted for and applied
as road funds under this act, as if it were a county levy, except
that the funds collected from each magisterial district shall be
kept separate and apart by the countv treasurer, and the funds
collected in each magisterial district shall be applied to the con-
struction, working and keeping in repair of the roads and bridges
in such district.
The said board of supervisors shall have the right to make
the rate of tax on each hundred dollars in value of such property
different in each magisterial district in said county, and the said
board is authorized to levy and appropriate for general road pur-
poses along with the said property tax the capitation tax of fifty

cents on each male citizen over twenty-one years of age, as
allowed under the Constitution of the State, to be likewise col-
lected by. the said ertinty treasurer, which capitation shall be
separated and applied in the various districts in the same man-
ner as the levy above provided for.
7. The said county road board shall have the right to apply
for and receive, and make use of, under this act, such State money
or convict aid as may be properly applicable to the county of
Appomattox under the general laws of the State on those sub-
jects.
8. The act entitled an act to provide a road law for Appo-
mattox county and to repeal all acts in conflict therewith, ap-
proved March fourteenth, nineteen hundred and four, as amended
and re-enacted by an act approved March fourteenth, nineteen
hundred and eight (acts of assembly, nineteen hundred and eight,
page five hundred and eighty-three), is hereby repealed. —
9. All other acts or parts of acts in conflict with this act
are hereby repealed.
10. An emergency existing because of the fact that the road
commissioners provided for by the present road law hereby re-
pealed would by that law be re-elected by November of this year,
this act shall be in force from its passage.
