CHAP. 10.—An ACT to authorize the board of supervisors of Wise county
to borrow money and issue bonds of the Gladeville magisterial dis-
trict thereof for a sum not exceeding $80,000.00 for the purpose of
constructing and improving a public road and the necessary bridges
on and along same, in the said Gladeville magisterial district alon
the Roaring Fork of Powell’s river and the Pot Camp Fork of sai
Roaring Fork, beginning at the Richmond magisterial district line at
the northern end of the said district public road leading from the State
highway between Appalachia and Norton, thence up and near Roaring
Fork and Pot Camp Fork through the villages of Roaring Fork and
Dunbar to the village of Pardee in said Gladeville magisterial district,
and to levy taxes to pay the interest thereon and to create a sinking
fund for the payment of such bonds at maturity. [H B 31]

Whereas, there are. several thousand people regularly living
in the Gladeville magisterial district of Wise county in the valley
of the Roaring Fork of Powell’s river and the Pot Camp Fork
thereof in and near the villages of Roaring Fork, Dunbar and
Pardee who have no access to any public road or any kind of
vehicle road whatsoever; and new enterprises now under way
or projected for early development will greatly increase the popu-
lation in said valley;
Whereas, the board of supervisors of Wise county, consider-
ing the insistent demand of the citizens and realizing the im-
perative need for such a road, after taking and requiring the
necessary preliminary steps, did on the fourteenth day of Au-
gust, nineteen hundred and nineteen, enter an order establish-
ing a standard public road in said Gladeville magisterial district
along and near said water courses, beginning at the Richmond
magisterial district line at the northern end of the said district
public road leading from the State highway between Appalachia
and Norton, thence up and near Roaring Fork and Pot Camp
Fork through the villages of Roaring Fork and Dunbar to the
village of Pardee in said Gladeville magisterial district, with
the necessary bridges on and along same:
Whereas, Wise county has not funds, nor has it for use in
said Gladeville magisterial district funds, presently or in the
near future, available for additional road building and improve-
ments in said districts or for use in building and improving said
road and bridges;

Whereas, ‘certain corporations engaged and proposing to en-
rage in enterprises along and near the said proposed road have
yffered, in the event the said road is constructed, that they will
free of any expense to the public, place on the said road a top
-overing of coke cinder and ashes, or some other equally as good
-‘rowning material, and. have the same properly rolled, surfaced
und finished to the end that the said roadway may be placed in
4 suitable condition for the use of the public for wheel. travel
»f all kinds and that the said road-bed and roadway may be best
conserved and kept up; and,
Whereas, the board of supervisors of Wise county, consider-
ing the great public need for the immediate construction and im-
provement of such road and bridges, and desiring to obtain the
assistance aforesaid, in regular meeting:assembled on August
fourteenth, nineteen hundred and nine, entered an order setting
forth the above facts, and requesting the general assembly of
Virginia to grant Wise county power to issue and sell district
road bonds for and on behalf of said Gladeville magisterial dis-
trict, the proceeds whereof to be used in constructing and im-
proving said road and bridges; therefore,
. Be it enacted by the general assembly of Virginia, That
the board of supervisors of Wise county be, and it is hereby au-
thorized and empowered, in its discretion to proceed immediately,
and from time to time, as it may deem expedient, to issue bonds
of the Gladeville magisterial district of said county for the said
Gladeville magisterial district, but the full faith and credit of
the entire county of Wise is to be pledged for the payment there-
of, not exceeding in the aggregate the sum of eighty thousand
dollars, for the purpose of providing funds to build and improve
a public road with the necessary bridges on and along same, in
the Gladeville magisterial district of Wise county along and near
the Roaring Fork of Powells’ river and the Pot Camp Fork of
Roaring Fork, beginning at the Richmond magisterial district
line at the northern end .of the said district public road leading
from the State highway between Appalachia and Norton, thence
up and near Roaring Fork and Pot Camp Fork through the vil-
lages of Roaring Fork and Dunbar to the village of Pardee in
said Gladeville magisterial district; such bonds to be payable o1
redeemable at such time or times not exceeding thirty years fror
the date of issue, and to bear interest payable semi-annually at
such rate not exceeding six per centum per annum, and to be of!
such denominations, and to be either coupon or registered, a:
the said board of supervisors may determine. The sale of suck
bonds may be conducted and effected in such manner as the saic
board of supervisors may determine; provided such bonds shal
not be sold at less than their par value.
2. The said board of supervisors shall annually levy a tas
upon all the property within said Gladeville magisterial district
subject to taxation for such purpose including such property
located, or the situs for taxation whereof may be, within the
limits of any incorporated towns therein which maintain their
own streets, at such rate as will be sufficient to pay the interest
on such district bonds, and to create a sinking fund for the pay-
snent of the principal thereof at maturity.
By reason of the fact that the public interest requires that
said road be constructed and improved immediately, an emer-
gency -is hereby declared to exist, and this act shall be in force
from its passage.
