Chap. 97.—An ACT authorizing and directing the road authorities of Totars
magisterial district, in Brunswick county, Virginia, and the board of
supervisors of the said county, to expend any surplus, now in the hands
of said authorities, arising from the sale of road bonds of said district.
in the paving, macadamizing, or otherwise permanently improving Main
street, in the town of Lawrenceville, in said district. where said street is
adjacent te and abuts upon the courthouse square of sald county.

Whereas, by an act of the general assembly of Virginia, approved
March thirteenth, nineteen hundred and twelve, (acts nineteen hun-
dred and twelve, page five hundred and seven) the various magis-
terial districts in the counties of the State, were authorized and em-
powered to submit to the qualified voters thereof, the issuing of
bonds, for the macadamizing or otherwise permanently improving
the roads in said districts; and,
Whereas, by an order made by the circuit court for the said coun-
ty of Brunswick, entered on the twenty-fifth day of April, nineteen
hundred and twelve, an election was in conformity with the said
statute, ordered, directing that the voters of said district determine
at an election to be held for the purpose, upon an issue of bonds of
the said district in the sum of fifty thousand ($50,000.00) dollars.
for the permanent improvement or macadamizing of certain specified
public roads in said district; and
Whereas. in pursuance of said order, an election was held in said
district on the eighth day of June, nineteen hundred and twelve, at
which a majority of said voters voted in favor of the issuance of
said bonds, for the purpose aforesaid; and,
Whereas, on the twenty-eighth day of June, nineteen hundred and
twelve, the said court, by its order, directed the board of supervisors
of said county, as provided by said statute to proceed to carry into
effect the wishes of said voters, as shown by said election, and to
proceed to issue said bonds for the purpose as aforesaid, of ma-
cadamizing or otherwise permanently improving the public roads
in said district, in said proceedings and orders specifically set forth;
and
Whereas, as required by said last mentioned order, the said board
of supervisors, did, at its next regular meeting thereafter, proceed
to direct the issuing of the bonds of the said district for the sum of
fifty thousand ($50,000.00) dollars aforesaid, and the same were
sold, and the proceeds therefrom paid over to the proper officer o1
said county, to be used and expended in the macadamizing, or other
wise permanently improving the public roads aforesaid; and,
Whereas, the said roads have been so improved, including Mair
street in the said town of Lawrenceville, which is one of the road:
in the said proceedings directed to be improved; and,
Whereas, after the improvement aforesaid, there now remain
from the proceeds of said bonds, a surplus of approximately eigh
thousand ($8,000.00) dollars, which is available for the purpose o
permanent improvements of said roads and for no other purpose
and,
Whereas, it appears that although the said Main street, in the
said town, has been improved in the same manner as the other roads
in the said district, but that owing to the greater traffic and use to
which said street is subject, the said character of improvement made
thereon is not permanent; and,
Whereas, it further appears that the taxable values of the prop-
erty within the corporate limits of said town, which are liable for
the said bonded indebtedness of said district, are greatly in excess
of the proportionate part of the total amount of said funds expended
within the said town, and it further appearing that the said Main
street 1s greatly used, not only by the citizens of said district, but
by all of the citizens of the said county, especially where the same is
contiguous to the court house square of said county; pow, therefore,
1. Be it enacted by the general assembly of Virginia, That. the
road authorities of the said county of Brunswick, and of said Tota-
1o magisterial district in said county, shall, under the supervision
and with the direction of the State highway commission, expend the
said surplus from the sale of the said bonds, or a sufficient portion
thereof, in further paving, macadamizing, or otherwise permanently
improving said Main street in the said town of Lawrenceville, in
front of and where the same abuts upon and is contiguous to the
court house square, in said town. or such portion thereof as said
funds are sufficient to so improve, pave or macadamize.
2. For the purpose aforesaid, said authorities are required to
expend the whole, or a sufficient portion of the surplus now in their
hands from the sale of the bonds of said district, and except and
until said improvement, paving or macadamizing is done, said funds
shall be used for no other purpose whatsoever.
