Chap. 90.—An ACT to amend and re-enact section 104 of an act to incor-
porate the city of Newport News, in the county of Warwick, and to
provide a charter therefor, approved January 16, 1896, as amended.

1. Be it enacted by the general assembly of Virginia, That sec-
tion one hundred and four of an act to incorporate the city of New-
port News, in the county of Warwick, and provide a charter there-
for, approved January sixteenth, eighteen hundred and ninety-six,
as amended, be amended and re-enacted to read as follows:
Sec. 104. For the execution of its powers and duties, the coun-
cil may raise taxes annually by assessments in said city on all sub-
jects not withheld from city taxation by the State and such sub-
jects of taxation as have been, or may be, segregated to the city by
the State, for the purpose of taxation, such sums of money as may
be necessary to defray the expenses of the same, and in such man-
ner as it shall deem expedient (in accordance with the laws of this
State, and of the United States); provided, that no municipal levy
pon real and personal property in said city shall exceed eighty
cents upon the one hundred dollars, assessed value thereof, but bv
a three-fourths vote of the entire council, such rate of levy may be
fixed and made at an amount not exceeding two dollars; and pro-
vided, further, that all levies upon real estate shall be upon the
assessed value thereof for the purposes of taxation.
