years ending, respectively, on the 28th day of February, 1919, and the

1. Be it enacted by the general assembly of Virginia, That the
public taxes and arrears of taxes, due prior to the first day of
March, in the year nineteen hundred and nineteen, and nineteen
hundred and twenty, respectively, as well as the revenue derived
from all sources, and all money not othewise appropriated which
shall come into the treasury prior to the first day of March, nine-
teen hundred and nineteen, and the first day of March, nineteen
hundred and twenty, respectively shall establish a general fund,
and be, and the same is hereby appropriated for the fiscal years
to close on the twenty-eighth day of February, nineteen hundred
and nineteen, and the twenty-ninth day of February, nineteen hun-
dred and twenty, respectively, in the following manner and for the
following uses, to-wit:

be considered only as approximate and that the commissioner, under

This latter sum to be turned over to the State board of educa-
tion and by that board apportioned as prescribed by the Constitu-
tion, to the public free schools of the several counties and cities of
the Commonwealth; provided, however, that the said State board
of education shall not apportion any of said fund to any county or
city unless said county or city pay out of local funds at least twenty
per centum of the teachers’ salaries in the schools of said county or
city; provided, however, that in exceptional cases the State board
of education may except from this rule a county which is unable to
pay more than ten per centum of teachers’ salaries; and provided,
further, that the schools are conducted for a term of not less than
seven months or for a period at least twenty days longer than the
term for the previous session, or for a period satisfactory to the
State board of education; and provided, further, that no portion
of this fund shall be paid to any county or city in which the aggre-
gate district and county tax for schools amounts to less than fifty
cents on the hundred dollars; and the board of supervisors of each
county and the council of each city, in the event that the maximum
school levies or appropriations allowed under the law will not yield
a sum of money necessary for the purposes herein specified, is
authorized, as provided by section one hundred and forty-one of the
Constitution, section fifteen hundred and twenty-nine of the Code,
and acts of the general assembly approved March seventeenth and
twenty-first, nineteen hundred and sixteen, to make appropriations
to meet the conditions herein purposed. However, from the said
sum turned over to the State board of education, as aforesaid, shall
be excepted forty thousand dollars, or so much thereof as may be
necessary, which the State board is authorized to expend in the
maintenance of summer normal schools and institutes; provided
that no Virginia teacher shall be charged tuition in said normal
schools or institutes. From the sum turned over to the State board
of education, as aforesaid, shall also be excepted the sum of one
thousand dollars, or so much thereof as may be necessary, which
the State board is authorized to expend in the maintenance of the
public free school at Laurel reformatory; the sum of twelve hun-
dred dollars, or so much thereof as may be necessary, which the
tate board is authorized to expend in the maintenance of the pub-
lic free schools at the negro reformatories in Hanover county; and
the sum of twelve hundred dollars, or so much thereof as may be
necessary, which the State board is authorized_to expend in the
maintenance of the public free school at the Virginia home and
industrial school for girls; and the further sum of seven hundred
and fifty dollars, or so much thereof as may be necessary, which the
State board is authorized to expend in the maintenance of the pub-
lic free school at the Virginia epileptic colony; and the further
sum of two thousand dollars or so much thereof as may be neces-
sary, which the State board is authorized to expend for rent of
offices which are rendered necessary by the crowded condition of
the capitol building; provided the rent of the offices in which the
department of education is housed is not paid out of the general
revenues of the State; and the further sum of one thousand dollars,
or so much thereof as may be necessary, which the State board is
authorized to expend in the encouragement of general or special
educational conferences.
There also shall be excepted from the sum to be turned over to
the State board of education, as aforesaid, the sum of two hundred
and fifty thousand dollars or so much thereof, as may be necessary,
to be used under the rules and regulations of the State board of edu-
cation for the establishment and maintenance of rural one-room
and two-room and graded schools, and for special supervision
thereof, and to be apportioned among such schools by the State
board of education and local authorities; provided that all the con-
ditions above imposed on the apportionment of the general appro-
priation of this act shall be applied to such special appropriation ;
provided, however, that the State board of education may use a sum
not to exceed twenty-five thousand dollars of this special appropria-
tion for the establishment and maintenance of vacation schools in
such sections of the State as said board may deem wise and proper.
For high schools, to be expended as per act creating
public high schools, one hundred thousand dollars;
provided that unless by separate act the amounts
necessary in order to meet the conditions of the fed-
eral act for vocational training in high schools,
known as the Smith-Hughes bill, are appropri-
ated then of the sum of five hundred and eighty
thousand dollars herein provided for the support of
the public and high schools an amount not exceed-
ing forty-eight thousand, one hundred and fifty-
five dollars for the year ending February twenty-
eighth, nineteen hundred and nineteen, and a sum
not exceeding sixty-three thousand four hundred
and sixty dollars for the year ending February
twenty-ninth, nineteen hundred and twenty, or so
much of said sums as may be necessary, shall be
devoted to the establishment and support of depart-
ments of vocational training in agriculture and
domestic economy in such high schools as may
be designated by the State board of education, to
be conducted under the joint rules and regulations
of the State board of education and the federal

tural extension department of the agricultural and

The department of Confederate records is hereby abolished, and
the reference books, muster rolls, record books, and equipment of
said department shall be forthwith delivered by the adjutant general
of Virginia to the library board, who shall take over and receive
the same in the State library.
The said muster rolls and the record books shall be deposited and
kept in the historical archives of the library, and it shall be the
duty of the librarian, who shall be the custodian of said records, to
make a complete index of the names of Confederate soldiers con-
tained in said record books, so that the same may be ready reference
to those seeking information.
It further shall be the duty of said librarian to furnish a certifi-
cate certifying the record of a Confederate soldier as the same shall
appear upon said records when applied to for such certificate.
For the purpose of carrying out the foregoing provis-
ions, the sum of one hundred and fifty dollars, or so
much thereof as may be necessary, is hereby ap-

and mechanical college and polytechnic institute,
the Virginia military institute, the University of
Virginia, and William and Mary college, may each
draw from the treasury of the State, from, funds
not otherwise appropriated, in addition to the sum
appropriated to the support of these institutions, an-
nually, a sum not to exceed one per centum for each
year’s appropriation to said institutes, for support,
which sums shall be used for the establishment of
the State students’ loan fund at each of the several
institutions, respectively, three thousand eight hun-

To the State normal school for women at Fredericks-
burg, for the year ending February twenty-eighth,
nineteen hundred and sixteen, which was not col-
lected by the school to make the same available now,

Each of the said institutions shall, upon such terms, and ac-
cording to such rules as may be prescribed by the respective boards
of trustees or visitors, make loans from the said State students’
loan fund to needy and deserving students of talent and character
from Virginia in the academic departments in said institutions for
the purpose of aiding these to obtain an education at such institu-
tions, who might not be able otherwise to do so, the said loan shall
not exceed one hundred dollars in any one session to same student,
and shall be made to said student upon such terms as to time and
security as the authorities of the respective institutions shall deter-
mine in each case; provided, that the rate of interest charged stu-
dents on such loans shall be four per centum per annum.
The said State students’ loan fund shall be preserved from
depletion by the said institutions, and, together with the repayment
and accretions thereto, shall be held and used for the purpose speci-
fied in this act and no other; and each of the said institutions shall
annually, not later than July in each year thereafter, file in the
office of the State superintendent of public instruction a statement,
in detail, showing for the year past the amounts received by said
funds, or the loans made, to whom made, and upon what terms,
the amount of the corpus of said fund, the amounts repaid to said
funds, and from whom, and any other information deemed per-
tinent by the institution so reporting, or which may have been re-
quested by the superintendent of public instruction.
The auditor of public accounts shall make no payment to any
of the said institutions on account of the said students’ loan fund
unless and until the institution applying for such payment shall
have furnished the said auditor a certificate from the superintendent
of public instruction that such institution has complied in all re-
spects with the foregoing requirements of this act in relation there-
to, and the State accountant shall annually audit and exhibit in
his annual report the account of the said fund at each such institu-
tion.

The governor of Virginia, and four others, to be appointed by
himself, two from the State board of agriculture, and two from the

rated, shall constitute a committee of five to determine the number,

receive no compensation for their services. The appropriation
hereby made shall be subject to payment to the Virginia State fair
association, incorporated, upon order of the commission and by
warrant of its chairman, on October first, nineteen hundred and

The city of Charlottesville having, on August first,
nineteen hundred and sixteen, become a city of the
first class, the salary of the judge of the corporation
court of that city, on that date, became a charge
upon the State treasurer at an annual salary of
twenty-five hundred dollars a year, but nothing has
been paid by the State on account of that salary,
because no appropriation had been made. And the
city of Charlottesville, having paid on account of
the salary of the judge, three thousand nine hun-
dred and fifty-eight dollars and thirty-three cents
at the rate of twenty-five hundred dollars a year
from August first, nineteen hundred and sixteen to

stitution, to the public free schools of the several counties and

board of education shall not apportion any of said fund to any
county or city unless said county or city pay out of local funds
at least twenty per centum of the teachers’ salaries in the schools
of said county or city; provided, however, that in exceptional cases
the State board of education may except from this rule a county
which is unable to pay more than ten per centum of teachers’
salaries; and provided, further, that the schools are conducted for
a term of not less than seven months or for a period at least twenty
days longer than the term for the previous session, or for a period
satisfactory to the State board of education; and provided, further,
that no portion of this fund shall be paid to any county or city
in which the aggregate district and county tax for schools amounts
to less than fifty cents on the hundred dollars; and the board of
supervisors of each county and the council of each city, in the
event that the maximum school levies or appropriations allowed
under the law will not yield a sum of money necessary for the
purposes herein specified, is authorized, as permitted by section
one hundred and forty-one of the Constitution, section fifteen hun-
dred and twenty-nine of the Code, and acts of the general assembly
approved March seventeenth and twenty-first, nineteen hundred and
sixteen, to make appropriations to meet the conditions herein pro-
posed. However, from the said sum turned over to the State board
of education, as aforesaid, shall be excepted forty thousand dollars,
or so much thereof as may be necessary, which the State board is
authorized to expend in the maintenance of summer normal schools
and institutes; provided that no Virginia teacher shall be charged
tuition in said normal schools or institutes. From the sum turned
over to the State board of education, as aforesaid, shall also be
excepted the sum of one thousand dollars, or so much thereof as
may be necessary, which the State board is authorized to expend
in the maintenance of the public free school at Laurel reformatory;
the sum of twelve hundred dollars, or so much thereof as may |
necessary, which the State board is authorized to expend in the
maintenance of the public free schools at the negro reformatories
in Hanover county; and the sum of twelve hundred dollars, or so
much thereof as may be necessary, which the State board is auth-
orized to expend in the maintenance of the public free school at
the Virginia home and industrial school for girls; and the further
sum of seven hundred and fifty dollars, or so much thereof as may
be necessary, which the State board is authorized to expend in
the maintenance of the public free school at the Virginia epileptic
colony; and the further sum of two thousand dollars or so much
thereof as may be necessary, which the State board is authorized
to expend for rent of offices which are rendered necessary by the
crowded conditions of the Capitol building; provided the rent of
the offices in which the departemnt of education is housed is not
paid out of the general revenues of the State; and the further sum
of one thousand dollars, or so much thereof as may be necessary,
which the State board is authorized to spend in the encouragement
of general or special educational conferences.
There shall also be excepted from the sum to be turned over to
the State board of education, as aforesaid, the sum of two hundred
and fifty thousand dollars or so much thereof, as may be necessary,
to be used under the rules and regulations of the State board of
education for the establishment and maintenance of rural one-room
and two-room and graded schools, and for special supervision there-
of, and to be apportioned among such schools by the State board of
education and local school authorities; provided that all the con-
ditions above imposed on the apportionment of the general appro-
priation of this act shall be applied to such special appropriation;
provided, however, that the State board of education may use a
sum not to exceed twenty-five thousand dollars of this lal ap-
propriation for the establishment and maintenance of vacation
schools in such sections of the State as said State board may deem
wise and proper.
For high schools, to be expended as per act creating
public high schools, one hundred thousand dollars;
provided that unless by separate act the amounts
necessary in order to meet the conditions of the
federal act for vocational training in high schools
known as the Smith-Hughes bill, are appropria
then of the sum of five hundred and eighty thousand
dollars herein provided for the support of the public
and high schools an amount not exceeding forty-
eight thousand, one hundred and fifty-five dollars
for the year ending February twenty-eighth, nine-
teen hundred and nineteen, and a sum not exceed-

StupEnt’s Loan Funp.
The State normal at Farmville, the State normal and
industrial schools for women at Harrisonburg,
Fredericksburg, and Radford, the Virginia agricul,
tural and mechanical college and polytechnic insti-
tute, the Virginia military institute, the University
of Virginia, and William and Mary college, may
each draw from the treasury of the State, from
funds not otherwise appropriated, in addition to
the sum appropriated to the support of these insti-
tutions, annually a sum not to exceed one per centum
for each year’s appropriation to said institutes, for
support, which sums shall be used for the establish-
ment of the State students’ loan fund at each of the
several institutions, respectively, three thousand

Each of the said institutions shall, upon such terms, and ac-
cording to such rules as may be prescribed by the respective boards
of trustees or visitors, make loans from the said State students’
loan fund to needy and deserving studetts of talent and character
from Virginia in the academic departments in said institutions
for the purpose of aiding these to obtain an education at such 10-
stitutions, who might not. be able otherwise to do so, the said loan
shall not exceed one hundred dollars in any one session to same
student, and shall be made to said student upon such terms as to
time and security, as the authorities of the respective institutions
shall determine in each case; provided, that the rate of interest
charged students on such loans shall be four per centum per annum.
The said State students’ loan fund shall be preserved from de-
pletion by the said institutions, and, together with the repayment
and accretions thereto, shall be held and used for the purpose speci-
fied in this act and no other; and each of the said institutions shall
annually, not later than July in each year thereafter, file in the
office of the State superintendent of public instruction a state-
ment, in detail, showing for the year past the amounts received
by said funds, or the loans made, to whom made, and upon what
terms, the amount of the corpus of said fund, the amounts repaid
to said funds, and from whom, and any other information deemed
pertinent by the institution so reporting, or which may have been
requested by the superintendent of public instruction. The auditor
of public accounts shall make no payment to any of the said insti-
tutions on account of the said students’ loan fund unless and unttl
the institution applying for such payment shall have furnished
the said auditor a certificate from the superintendent of public
Instruction that such institution has complied in all respects with
the foregoing requirements of this act in relation thereto, and the
State accountant shall anuually audit and exhibit in his annual
report the account of the said fund at each such institution.

himself, two from the State board of agriculture, and two from

shall receive no compensation for their services, The appropria-
tion hereby made shall be subject to payment to the Virginia State
fair association, incorporated, upon order of the commission and
by warrant of its chairman, on October first, nineteen hundred
and eighteen.
Houpon STATUE FOR GREAT BRITAIN.
To pay the cost of making and expenses in presenting
to the government of Great Britain a replica, or
copy in bronze, of the Houdon statue of George
Washington, to be made from the moulds now
owned by the State, under the direction of, and to be
presented by a commission composed of the gover-
nor, lieutenant governor, speaker of the house of
delegates, or such person or persons, as they may
each designate to represent them, and the clerk of
the house of delegates, who shall also act as secre-

CoMMISSIONER OF PROHIBITION.
I’or the purpose of carrying into effect the act of the
general assembly relating to ardent spirits as therein
defined, commonly known as the prohibition bill,
there is hereby appropriated out of any money in
the treasury of Virginia, not otherwise appropri-
ated, for the year ending February twenty-ninth,
nineteen hundred and twenty, the sum of fifty thou-
sand dollars. The money appropriated shall be
paid upon the warrants of the con missioner, which
warrants shall show the purposes for which the ex-

RENT OF STATE OFFICES.
For rent of suitable quarters for State departments, to
be selected by the governor and paid out by the
auditor of public accounts on order of the governor,
who shall make an itemized report of expenditures
to the general assembly, a sum not to exceed ten

Provided, that no part of any appropriation shall be available
for the purpose of increasing the salary of any official of any such
public institution when such official is now receiving a salary °
more than three thousand dollars per annum, including perquisites,
unless such increase is herein specifically provided.
To the State tax board, to carry out the provisions of
chapter two hundred and fifteen, acts of the general
assembly, approved March seventeenth, nineteen
hundred and sixteen, the sum of ten thousand dol-
lars, or so much thereof as may be necessary, to be
paid out of any funds in the treasury not otherwise
appropriated upon the warrant of the chairman,
countersigned by the secretary of the said board..$ 10,000 00
All public revenue received into the treasury within the two
appropriation years provided for in this act and the balances of
the appropriations made by previous acts of assembly unexpended
at the close of business on the twenty-eighth of February, nimeteen
hundred and eighteen, which unexpended balances are hereby de-
clared to be lapsed into the treasury, are hereby designated the
general fund of the Commonwealth, and shall be used for the
payment of the appropriations provided for in this act subject to
the limitations and upon the conditions set out in this act, and
shall be used also for the payment of all other appropriations made
by acts of assembly passed at the session of the general assembly
of Virginia which commenced at the State capitol on Wednesday,
January ninth, nineteen hundred and eighteen. The appropriations
for the support to public institutions and hospitals for the insane
shall be paid in monthly installments, but the auditor of public
accounts is hereby authorized and required to pay the special or
extraordinary appropriations (other than support) to the insti-
tutions and hospitals for the insane in monthly installments, or
otherwise as in his judgment the condition of the treasury will
permit.
No institution in this State, except hospitals for the insane, shall
hereafter exceed the amount of its aprpopriation, and if any such
institution shall exceed the amount of its appropriation, there shall
be no reimbursement of said excess, nor shall there be any liability
or obligation upon the State to make any appropriation hereafter
to meet such deficit, and the members of any board making any
such excessive expenditures, who shall have voted therefor, shall, in
the discretion of the governor, be deemed guilty of neglect of official
duty, and be subject to removal therefor.
Ti shall not be lawful for the auditor of public accounts to
pay the State hospitals, or any other institutions, any money except
as is provided for in this act, or in pursuance of some act making
a special appropriation therefor. And the proper officer of each
public institution of the State, for which appropriation is made,
shall, in his annual report, give an itemized account of the expen-
ditures of such appropriations for such institutions; and every
officer of this State for whose department appropriations are hereby
made, shall make annually a report covering an itemized account
of the expenditures of such appropriation, and of all. other sums
received by such institutions, departments, or officers for any source,
and such reports and accounts shall embrace the expenditure of
all funds appropriated, including the interest on bonds held by
such institutions and hereinbefore directed to be paid to them,
which reports shall be forwarded to the general assembly and laid
before both houses thereof on the first day of each session thereof.
None of the moneys mentioned in this act shall be expended for
any other purpose than that for which they are specifically appro-
priated. All of the appropriations herein made for the fiscal year
ending February twenty-ninth, nineteen hundred and twenty, unex-
pended at the close of business, February twenty-ninth, nineteen
hundred and twenty, shall revert to and become a part of the
general fund of the Commonwealth, and shall not thereafter be
paid by the auditor of public accounts, and the same shall be
charged off upon the books of his office.
2. All acts and parts of acts inconsistent herewith are hereby
repealed.
