Chap. 309.—An ACT to amend and reenact section 4 of an act entitled an
act concerning the appointment of a dairy and food commissioner within
the department of agriculture and immigration, and imposing penalties
for its violation, approved March 11, 1908S, and to repeal section 15-a of
an act entitled an act to prevent the manufacture or sale of adulterated,
misbranded, poisonous or deleterious stock and cattle feeds, and to repeal
section 15 and sub-sections a, b, c, d, e, f, and g of said section 15, chap-
ter 188, acts of assembly, 1908, approved March 11, 1908, and to repeal
all other laws in conflict with this act, in so far as they may be in con-
flict with the provisions of this act, approved March 14, 1910.

1. Be it enacted by the general assembly of Virginia, That sec-
tion four of an act entitled an act concerning the appointment of
a dairy and food commissioner within the department of agricul-
ture and immigration, and imposing penalties for its violation,
approved March eleventh, nineteen hundred and eight, (being sec-
tion eleven hundred and fifty-eight of the report of the revisors of
the Code of Virginia) be amended and re-enacted so as to read as
follows:
See. 4. There shall be a deputy dairy and food commissioner,
who shall be appointed by the commissioner of agriculture and im-
migration and the dairy and food commissioner, acting jointly, sub-
ject to the confirmation of the State board of agriculture and immi-
gration. The salary of said commissioner and of the deputy com-
missioner shall be paid out of appropriation made by the general
assembly for that specific purpose. The said commissioners may
also appoint by and with the advice of the board of agriculture
and immigration, such other special assistants as the proper per-
formance of the duties of the office may require, which such assist-
ants shall be paid for the time actually employed, as said commis-
sioner and board may direct. The persons so appointed shall have
the power to administer oaths in all matters relative to the dairy
and food laws, and shall take and subscribe to the constitutional
oath of office and file the same in the office of the secretary of the
A’ommonwealth; and they shall héld office during the pleasure of
‘fhe commissioners. The assistants shall have the same right of
access to the places to be inspected as the said commissioner. The
salaries are to be paid semi-monthly. The salaries and actual and
necessary expenses of the said commissioner; deputy commisioner
and assistants, in the performance of their official duties, shall be
paid upon warrants issued by the dairy and food commissioner
upon the State auditor, and which shall be audited by the State
board of agriculture and immigration and by the State accountant.
