Chap. 273.—An ACT to amend and re-enact section 3535 of the Code of Vir-
ginia. (H. B. 376.)

1. Be it enacted by the general assembly of Virginia, That
section thirty-five hundred and thirty-five of the Code of Virginia
be amended and re-enacted so as to read as follows:
Sec. 3535. Fees collected of defendant, how disposed of.—All
fees to officers in a case of felony, if there be a judgment for the
same against the defendant, shall, when collected, be paid by the
officer collecting the same, to the clerk of the circuit court of the
county or te the clerk of the corporation (or hustings) court of the
city in which the judgment was rendered, and shall be paid by such
clerk into the treasury. All fees to officers in a case of misdemeanor,
if there be a judgment for the same against the defendant, shall,
when collected, be paid by the officer collecting the same, to the clerk
of the circuit court of the county or to the clerk of the corporation
(or hustings) court of the city in which the judgment was ren-
dered, and shall be paid by the clerk as follows: if it be a case
in which the officers can be and have been allowed one-half of the
fees payable out of the treasury, then the clerk shall pay one-half
of the fees to the officers and one-half of the fees into the treasury,
but if it be a case in which the officers can not be allowed and paid
one-half fees out of the treasury, then the clerk shall pay to the
officers their fees in full.
