Chap. 107.—An ACT to amend and re-enact an act entitled an act to create
a road board for the county of Fauquier, and to provide for the working
of the roads of said county, approved March 8, 1904, as amended and
re-enacted by an act approved March 14, 1906, and as further amended
by an act approved March 11, 1908, and to provide for the building
and repair of bridges in said county, and as further amended and re-
enacted by an act approved March 9, 1910. (H. B. 107.)

1. Be it enacted by the general assembly of Virginia, That
section twelve be amended and re-enacted so as to read as follows:
Sec. 12. In order to properly maintain the macadamized roads
of the several magisterial districts, the respective magisterial dis-
trict road boards shall have the power to erect, maintain and operate
toll gates and demand and collect tolls on the roads in their respec-
tive districts, and such tolls shall only be expended in maintenance
and repair of those roads on which toll gates are established, and
shall be collected under such rules and regulations as may be pre-
scribed by said board; provided, however, that said rates shall not
exceed those fixed by the general law for turnpike companies.
The clerk of the said district road board of the district in which
toll gates are established shall be charged with the collection of
tolls, which when collected by said clerk shall be paid to the county
treasurer and disbursed upon warrant of said board, providing that
before collecting any money said clerk shall enter into a bond in
such amount as the judge of the circuit court, either in term time or
in vacation, may prescribe with approved security, conditioned for
the faithful performance of his duties; and provided, further, that
should said roads not be kept in cendition, said toll gates may be
abandoned and removed upen such application and conditions as
are now prescribed by the general law for the removal of toll gates
on the turnpike roads cf this State.
2. An emergency existing by reason of the fact that the macad-
amized roads need repairing, this section, as amended, shall be en-
forced from its passage.
