CHAP. 41.—An ACT authorizing the council of the city of Radford, Vir-
ginia, to have issued and sold bonds of the city of Radford, Virginia,
to the amount of $35,000.00 for general public improvements for school
purposes.

Whereas, the council of the city of Radford, Virginia, by an
ordinance of the said council, number one hundred and fifty-two,
which was adopted on the twenty-fifth day of April, nineteen
hundred and ten, by the said council and approved by more
than a majority of the freehold voters of the said city of Rad-
ford in an election held on the thirty-first day of May, nineteen
hundred and ten, authorized to be issued bonds of the city of
Radford, Virginia, to the amount of thirty-five thousand
($35,000) dollars, dated July first, nineteen hundred and ten,
payable thirty years after date. The said bonds to be of the
denomination of one thousand ($1,000) dollars each, numbered
from one to thirty-five, both inclusive, and to bear interest at the
rate of five per centum per annum, payable semi-annually, on
the first days of January and July, and to be of the style and
form known as coupon bonds; and |
Whereas, it appears that the council of the city of Radford
undertook to sell and actually did sell said bonds upon the con-
dition that the attorney of the purchaser should be able to deter-
mine that such bonds could be legally issued under the authority
of the Constitution and laws of the State of Virginia; and
Whereas, it has been determined by the attorney of the said
purchaser that grave doubt exists as to whether there is any
existing authority to issue such bonds without further authority
being conferred by the general assembly of the State of Vir-
ginia to the city of Radford therefor, the legal question raised
by the attorney of the purchaser being that the erection of
school houses and maintaining a system of public free schools
in the city of Radford is not such a municipal purpose for which
the said city, under the provision of its present charter, is
authorized to issue bonds; and
Whereas, it is desired by the council of the city of Radford
to set at rest any possible question as to its authority to issue
said bonds and to use the proceeds realized from the sale of the
said bond issue to pay for certain school buildings that have
already been erected within the corporate limits of the said city
for public school purposes upon the belief of the council of the
city of Radford that they had lawful authority so to do;
1. Now, therefore, be it enacted by the general assembly of
Virginia, That the council of the city of Radford, Virginia, be,
and hereby is, authorized to execute and issue and sell the bonds
of the city of Radford to the amount of thirty-five thousand
($35,000) dollars as provided in said ordinance, and the said
bonds when sold and delivered in accordance with the terms of
the said ordinance of the council of the city of Radford shall
be deemed valid and binding obligation of the city of Radford,
Virginia, and that all steps and proceedings that have already
been taken or had by the council of the city of Radford to issue
said bonds be and they are each and all declared to be regular
and valid.
2. An emergency existing for the immediate operation of
this act, in that the city of Radford is unable to carry out its
contract to pay for the said school buildings which have been
erected within the corporate limits of the said city of Radford,
this act shall be in force from its passage.
